Si un accord collectif d\u2019entreprise pr\u00e9voit des dispositions particuli\u00e8res \u00e0 ce sujet, il prime sur la convention collective. Il peut par exemple, pr\u00e9voir le d\u00e9lai dans lequel la date de prise des cong\u00e9s peut \u00eatre modifi\u00e9e.<\/p>\n<p>Si aucun accord n\u2019encadre cette situation, il faut se r\u00e9f\u00e9rer \u00e0 la loi. Le code du travail dispose que l\u2019ordre et les dates ne peuvent pas \u00eatre modifi\u00e9s moins d\u2019un mois avant ce qui avait \u00e9t\u00e9 pr\u00e9vu. Ce d\u00e9lai est d\u00e9compt\u00e9 \u00e0 partir de la date \u00e0 laquelle le salari\u00e9 est inform\u00e9 du report de ses cong\u00e9s.<\/p>\n<p>Cependant, il existe une exception \u00e0 ce principe. Les dates et l\u2019ordre des d\u00e9parts peuvent \u00eatre modifi\u00e9s en cas de circonstances exceptionnelles. Elles le sont notamment en cas de difficult\u00e9s \u00e9conomiques ou de raisons imp\u00e9ratives qui s\u2019av\u00e8rent particuli\u00e8rement contraignantes. Par exemple, il peut s\u2019agir de raisons professionnelles pour la bonne marche de l\u2019entreprise (une commande impr\u00e9vue particuli\u00e8rement n\u00e9cessaire \u00e0 honorer pour l\u2019avenir de l\u2019entreprise\u2026), du remplacement d\u2019un salari\u00e9 d\u00e9c\u00e9d\u00e9, etc\u2026 Le salari\u00e9 dont les cong\u00e9s ont \u00e9t\u00e9 report\u00e9s doit \u00eatre d\u00e9dommag\u00e9 des frais dus \u00e0 ce changement.<\/p>\n<p>Si les r\u00e8gles ont \u00e9t\u00e9 respect\u00e9es, le salari\u00e9 ne peut pas refuser le report de ses cong\u00e9s sans commettre une faute.
