Ces clauses entrainent l\u2019obligation, g\u00e9n\u00e9ralis\u00e9e \u00e0 l\u2019ensemble des entreprises de la branche, de souscrire un contrat de compl\u00e9mentaire sant\u00e9 ou de pr\u00e9voyance couvrant ainsi tous les salari\u00e9s de la branche aupr\u00e8s de l\u2019organisme d\u2019assurance d\u00e9sign\u00e9 par les interlocuteurs sociaux.<\/p>\n<p>Y voyant une atteinte au droit de la n\u00e9gociation collective, Force Ouvri\u00e8re a port\u00e9 cette d\u00e9cision devant le Comit\u00e9 europ\u00e9en des droits sociaux, qui vient de lui donner gain de cause. \u00c0 l\u2019unanimit\u00e9, il conclut \u00e0 une violation de l\u2019article 6 alin\u00e9a 2 de la Charte sociale europ\u00e9enne\u00a0: l\u2019interdiction g\u00e9n\u00e9rale des clauses de d\u00e9signation n\u2019est pas proportionn\u00e9e au but l\u00e9gitime poursuivi.<\/p>\n<p>Force Ouvri\u00e8re s\u2019en f\u00e9licite\u00a0: cette d\u00e9cision est une grande victoire pour la mutualisation, dans un domaine o\u00f9 elle prend tout son sens. La mutualisation permet en effet de pr\u00e9server la logique de solidarit\u00e9 en mati\u00e8re de protection sociale compl\u00e9mentaire en m\u00eame temps que l\u2019\u00e9galit\u00e9 de traitement entre salari\u00e9s d\u2019une m\u00eame branche professionnelle. Elle garantit par ailleurs un niveau de prestation et de cotisation, l\u00e0 o\u00f9 les clauses de recommandation ouvrent le march\u00e9 de la pr\u00e9voyance \u00e0 la concurrence lucrative.<\/p>\n<p>Ce rapport du Comit\u00e9 europ\u00e9en des droits sociaux vient d\u2019\u00eatre transmis au Comit\u00e9 des ministres.
