C\u2019est la question \u00e0 laquelle la Cour de cassation a r\u00e9pondu par un arr\u00eat du 12 septembre dernier.<span id=\"more-12877\"><\/span><\/p>\n<p>En l\u2019esp\u00e8ce, une salari\u00e9e a \u00e9t\u00e9 licenci\u00e9e pour faute grave en raison des propos injurieux et mena\u00e7ants qu\u2019elle a tenus \u00e0 l\u2019\u00e9gard de sa sup\u00e9rieure hi\u00e9rarchique. Ces propos ont \u00e9t\u00e9 tenus sur un groupe Facebook ferm\u00e9, accessible \u00e0 14 personnes seulement. Chacune d\u2019elles avaient \u00e9t\u00e9 agr\u00e9e en tant que membre du groupe.<\/p>\n<p>Les juges de la cour d\u2019appel, comme ceux de la Cour de cassation, ont estim\u00e9 que ces propos relevaient d\u2019une conversation de nature priv\u00e9e dans la mesure o\u00f9 elle n\u2019\u00e9tait accessible qu\u2019\u00e0 un nombre restreint d\u2019interlocuteurs dont l\u2019acc\u00e8s au groupe avait \u00e9t\u00e9 soumis \u00e0 autorisation. D\u00e8s lors, les \u00e9changes litigieux ne pouvaient pas caract\u00e9riser la faute grave ni la cause r\u00e9elle et s\u00e9rieuse du licenciement.<\/p>\n<p>Le juge attache beaucoup d\u2019importance au champ de diffusion des propos pour estimer la nature de la conversation.\u00a0 Ainsi, la faute s\u00e9rieuse a \u00e9t\u00e9 retenue pour des injures tenues sur un mur en acc\u00e8s libre, pour des insultes qui pouvaient \u00eatre lues par les clients ou les autres salari\u00e9s ou encore lorsque le nombre \u00ab\u00a0d\u2019amis\u00a0\u00bb est num\u00e9riquement trop important pour \u00e9tablir l\u2019existence d\u2019une sph\u00e8re priv\u00e9e d\u2019\u00e9changes.<\/p>\n<p>Cette jurisprudence consolide la protection de la libert\u00e9 d\u2019expression individuelle des salari\u00e9s, qui peuvent en faire usage, m\u00eame en critiquant l\u2019entreprise dans la sph\u00e8re priv\u00e9e.
