En l\u2019esp\u00e8ce, une soci\u00e9t\u00e9 \u00e9tait engag\u00e9e dans un processus de r\u00e9organisation, impliquant un r\u00e9am\u00e9nagement de locaux et un d\u00e9placement de personnel. Dans ce contexte, un salari\u00e9 voit son agence supprim\u00e9e, se trouve ainsi priv\u00e9 de ses instruments et outils de travail, et donc dans l\u2019impossibilit\u00e9 d\u2019exercer ses fonctions.<\/p>\n<p>Souhaitant en savoir plus sur ses futures missions au sein de l\u2019entreprise, il adresse un premier courrier \u00e0 son employeur, lequel se contente de lui promettre \u00ab l\u2019organisation d\u2019une r\u00e9union pour d\u00e9terminer la strat\u00e9gie \u00bb d\u00e8s que le processus de d\u00e9m\u00e9nagement sera termin\u00e9.<\/p>\n<p>\u00c0 la suite d\u2019une deuxi\u00e8me lettre rest\u00e9e sans r\u00e9ponse, l\u2019employ\u00e9 a pris acte de la rupture de son contrat de travail. Selon lui, l\u2019employeur a manqu\u00e9 \u00e0 son obligation de lui fournir les outils pour exercer son travail, et lui reproche de l\u2019avoir laiss\u00e9 dans l\u2019expectative sur les modalit\u00e9s entourant sa reprise d\u2019activit\u00e9.<\/p>\n<p>La Cour d\u2019appel, confirm\u00e9e par la Cour de cassation, valide ce raisonnement, estimant que le fait pour un employeur, m\u00eame dans une p\u00e9riode de r\u00e9organisation interne, de ne pas r\u00e9pondre aux demandes d\u2019un salari\u00e9 demandant des pr\u00e9cisions sur la nature et l\u2019\u00e9tendue de ses futures missions, constitue une faute grave de nature \u00e0 justifier les effets d\u2019un licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p><strong>SOURCE : Cass.
