Elle suppose une mauvaise volont\u00e9 d\u00e9lib\u00e9r\u00e9e (Cass.&nbsp;soc., \n16-2-12, n\u00b010-18162).<\/p>\n\n\n\n<p>L\u2019inex\u00e9cution fautive ou l\u2019ex\u00e9cution volontairement d\u00e9fectueuse du \ntravail (baisse volontaire de rendement\u2026) peut justifier une sanction \ndisciplinaire mais les simples insuffisances professionnelles ne \nsauraient constituer des fautes (Cass. soc., 19-6-02, n\u00b000-43602).<\/p>\n\n\n\n<p>L\u2019insuffisance professionnelle se d\u00e9finit comme l\u2019incapacit\u00e9 du salari\u00e9 \u00e0 ex\u00e9cuter son travail de fa\u00e7on satisfaisante.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Des erreurs ou autres n\u00e9gligences imputables au salari\u00e9 ne peuvent \nrev\u00eatir un caract\u00e8re fautif (Cass. soc., 23-5-13, n\u00b012-12914).<\/p>\n\n\n\n<p>En revanche, la r\u00e9p\u00e9tition des erreurs de caisse ainsi que l\u2019\u00e9normit\u00e9\n du d\u00e9ficit constat\u00e9 dans une seule journ\u00e9e caract\u00e9risent un manque \nd\u2019attention extr\u00eame de la part de la caissi\u00e8re et un total d\u00e9sint\u00e9r\u00eat \npour son travail constituant une faute et non une simple insuffisance \nprofessionnelle (Cass. soc., 28-11-06, n\u00b006-40013).<\/p>\n\n\n\n<p>Pour justifier un licenciement pour insuffisance professionnelle, \nl\u2019employeur doit se baser sur des faits objectifs, pr\u00e9cis et \nv\u00e9rifiables, imputables au salari\u00e9.<\/p>\n\n\n\n<p>Il peut notamment d\u00e9cider, en vertu de son pouvoir de direction, \nd\u2019\u00e9valuer un salari\u00e9. Le salari\u00e9 qui refuse de s\u2019y soumettre commettrait\n une faute grave.<\/p>\n\n\n\n<p>Toutefois, un r\u00e9sultat n\u00e9gatif \u00e0 un test professionnel ne suffit pas,\n \u00e0 lui seul, \u00e0 justifier un licenciement (Cass. soc., 18-7-00, \nn\u00b098-44591).<\/p>\n\n\n\n<p>L\u2019employeur qui n\u2019a pas d\u00e9livr\u00e9 au salari\u00e9 les formations suffisantes\n pour lui permettre d\u2019exercer convenablement ses fonctions ne peut \nvalablement pas prononcer un licenciement pour insuffisance \nprofessionnelle (Cass. soc., 29-11-07, n\u00b005-42004).<\/p>\n\n\n\n<p>Sauf dispositions conventionnelles particuli\u00e8res, l\u2019employeur, \nconfront\u00e9 \u00e0 un probl\u00e8me d\u2019insuffisance professionnelle, n\u2019a pas en \nprincipe l\u2019obligation de proposer au salari\u00e9 un poste de travail plus \nadapt\u00e9 \u00e0 ses capacit\u00e9s<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>La faute disciplinaire est un manquement du salari\u00e9 \u00e0 ses obligations professionnelles envers l\u2019employeur.
