de repos d\u2019un(e) salari\u00e9(e) du secteur priv\u00e9 \u00e0 un parent d\u2019un enfant gravement malade.<\/p>\n<p>Cette disposition l\u00e9gislative ajoute des articles dans la premi\u00e8re partie du code du travail sur les cong\u00e9s des salari\u00e9s pour maladie d\u2019un enfant.<\/p>\n<p><!--more--><\/p>\n<p><span style=\"text-decoration: underline;\">Le don de jours de repos d\u2019un(e) salari\u00e9(e) \u00e0 un parent d\u2019enfant gravement malade<\/span><\/p>\n<p>L\u2019article L1225-65-1 du Code du Travail pr\u00e9cise qu\u2019un salari\u00e9 peut, sur sa demande et en accord avec l\u2019employeur, renoncer anonymement et sans contrepartie \u00e0 tout ou partie de ses jours de repos non pris, qu\u2019ils aient \u00e9t\u00e9 affect\u00e9s ou non sur un compte \u00e9pargne temps, au b\u00e9n\u00e9fice d\u2019un autre salari\u00e9 de l\u2019entreprise qui assume <strong>la charge d\u2019un enfant \u00e2g\u00e9 de moins de 20 ans atteint d\u2019une maladie, d\u2019un handicap ou victime d\u2019un accident d\u2019une particuli\u00e8re gravit\u00e9 rendant indispensables une pr\u00e9sence soutenue et des soins contraignants.<\/strong><\/p>\n<p><strong>Le cong\u00e9 annuel ne peut \u00eatre c\u00e9d\u00e9 que pour sa dur\u00e9e exc\u00e9dant 24 jours ouvrables.<\/strong><\/p>\n<p>Le salari\u00e9, b\u00e9n\u00e9ficiaire d\u2019un ou plusieurs jours c\u00e9d\u00e9s, b\u00e9n\u00e9ficie du maintien de sa r\u00e9mun\u00e9ration pendant sa p\u00e9riode d\u2019absence.<\/p>\n<p>Cette p\u00e9riode d\u2019absence est assimil\u00e9e \u00e0 une p\u00e9riode de travail effectif pour la d\u00e9termination des droits que le salari\u00e9 tient de son anciennet\u00e9.<\/p>\n<p><strong>Le salari\u00e9 conserve le b\u00e9n\u00e9fice de tous les avantages qu\u2019il avait acquis avant le d\u00e9but de sa p\u00e9riode d\u2019absence.<\/strong><\/p>\n<p>L\u2019article L1225-65-2 du Code du Travail indique que la particuli\u00e8re gravit\u00e9 de la maladie, du handicap ou de l\u2019accident ainsi que le caract\u00e8re indispensable d\u2019une pr\u00e9sence soutenue et de soins contraignants sont attest\u00e9s par <strong>un certificat m\u00e9dical d\u00e9taill\u00e9, \u00e9tabli par le m\u00e9decin qui suit l\u2019enfant au titre de la maladie, du handicap ou de
