Un droit d\u2019acc\u00e8s \u00e0 quelles donn\u00e9es ?<\/strong><br \/>\nL\u2019int\u00e9ress\u00e9 peut obtenir communication de l\u2019ensemble des donn\u00e9es le concernant, qu\u2019elles soient conserv\u00e9es sur support informatique ou dans un dossier papier.<\/p>\n<p>Par exemple, il a le droit d\u2019acc\u00e9der aux donn\u00e9es relatives :<br \/>\n\u2022 \u00e0 son recrutement;<br \/>\n\u2022 \u00e0 son historique de carri\u00e8re;<br \/>\n\u2022 \u00e0 sa r\u00e9mun\u00e9ration;<br \/>\n\u2022 \u00e0 l\u2019\u00e9valuation de ses comp\u00e9tences professionnelles (entretiens annuels d\u2019\u00e9valuation, notation);<br \/>\n\u2022 \u00e0 son dossier disciplinaire, etc.<\/p>\n<p><strong>2. Limites au droit d\u2019acc\u00e8s<\/strong><br \/>\nLe salari\u00e9 ou ancien salari\u00e9 n\u2019a pas le droit d\u2019acc\u00e9der :<br \/>\n\u2022 aux donn\u00e9es concernant la situation personnelle d\u2019un tiers, notamment d\u2019un autre salari\u00e9;<br \/>\n\u2022 aux donn\u00e9es pr\u00e9visionnelles de carri\u00e8re (potentiel de carri\u00e8re, classement), sauf si ces donn\u00e9es ont \u00e9t\u00e9 prises en compte pour d\u00e9cider de son augmentation de salaire, de sa promotion, de son affectation, etc. Un salari\u00e9 doit ainsi pouvoir acc\u00e9der \u00e0 l\u2019ensemble des donn\u00e9es de gestion des ressources humaines qui ont servi \u00e0 prendre une d\u00e9cision \u00e0 son \u00e9gard.<\/p>\n<p>L\u2019employeur a le droit de s\u2019opposer aux demandes manifestement abusives. En cas de contestation, il doit d\u00e9montrer que la demande du salari\u00e9 est abusive.<\/p>\n<p><strong>3. Comment s\u2019exerce le droit d\u2019acc\u00e8s ?<\/strong><br \/>\nLe droit d\u2019acc\u00e8s peut s\u2019exercer soit sur place, soit par \u00e9crit, avec un justificatif d\u2019identit\u00e9.<\/p>\n<p>L\u2019employeur doit r\u00e9pondre imm\u00e9diatement si la demande est effectu\u00e9e sur place, ou dans un d\u00e9lai maximal de 2 mois si la demande est \u00e9crite (ou s\u2019il est impossible de r\u00e9pondre imm\u00e9diatement \u00e0 la demande sur place). Son \u00e9ventuel refus doit \u00eatre \u00e9crit, motiv\u00e9 et doit mentionner les voies et d\u00e9lais de recours.<\/p>\n<p>Une copie des donn\u00e9es est d\u00e9livr\u00e9e \u00e0 l\u2019int\u00e9ress\u00e9 \u00e0 sa demande.
