{"id":3144,"date":"2021-09-07T12:33:00","date_gmt":"2021-09-07T11:33:00","guid":{"rendered":"http:\/\/foastek.fr\/?p=3144"},"modified":"2023-04-15T21:34:49","modified_gmt":"2023-04-15T20:34:49","slug":"vos-droits-le-licenciement-prononce-a-lencontre-dun-salarie-pour-avoir-subi-ou-refuse-de-subir-des-agissements-repetes-de-harcelement-moral-est-nul","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=3144","title":{"rendered":"Le licenciement prononc\u00e9 \u00e0 l\u2019encontre d\u2019un salari\u00e9 pour avoir subi ou refus\u00e9 de subir des agissements r\u00e9p\u00e9t\u00e9s de harc\u00e8lement moral est nul"},"content":{"rendered":"\n<p>Cette protection s\u2019\u00e9tend au salari\u00e9 qui relate des faits de harc\u00e8lement moral, sauf mauvaise foi.<\/p>\n\n\n\n<p>Une salari\u00e9e est licenci\u00e9e apr\u00e8s avoir d\u00e9nonc\u00e9 par lettre un comportement fautif de son employeur.<\/p>\n\n\n\n<p>La Cour d\u2019Appel rejette sa demande en nullit\u00e9 du licenciement, au motif qu\u2019elle n\u2019\u00e9voquait pas un harc\u00e8lement moral mais \u00ab des agissements consistant en des humiliations, d\u00e9nigrements, comportements et propos vexatoires, ayant pour effet, si ce n\u2019est pour objet, une grave d\u00e9gradation de son \u00e9tat de sant\u00e9 physique et mental \u00bb.<\/p>\n\n\n\n<p>Selon la jurisprudence classique de la cour de cassation, le pourvoi de la salari\u00e9e aurait d\u00fb \u00eatre rejet\u00e9. Cependant la Cour de cassation (<strong>Cass.soc. 9 juin 2021 n\u00b020-15.525<\/strong>) casse la d\u00e9cision de la Cour d\u2019appel et accueille la demande de nullit\u00e9 du licenciement car, si la salari\u00e9e n\u2019invoquait pas un harc\u00e8lement dans sa lettre, l\u2019employeur \u00e9voquait comme grief, dans la lettre de licenciement, le fait pour la salari\u00e9e d\u2019avoir prof\u00e9r\u00e9 \u00ab des accusations de harc\u00e8lement tout \u00e0 fait inexactes \u00bb.<\/p>\n\n\n\n<p>La jurisprudence de cet arr\u00eat invite donc l\u2019employeur \u00e0 faire preuve de vigilance quant aux termes \u00e0 utiliser, ou \u00e0 ne pas utiliser, en mati\u00e8re de harc\u00e8lement moral.<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>Cette protection s\u2019\u00e9tend au salari\u00e9 qui relate des faits de harc\u00e8lement moral, sauf mauvaise foi.
