Mais qu&rsquo;en est-il des messages \u00e9crits ou \u00ab\u00a0SMS\u00a0\u00bb \u00e9chang\u00e9s \u00e0 partir du t\u00e9l\u00e9phone professionnel ?<\/p>\n<p>Dans un arr\u00eat rendu le 10 f\u00e9vrier 2015, la Cour de cassation a r\u00e9pondu \u00e0 cette question \u00e0 l\u2019occasion d\u2019un litige commercial de d\u00e9bauchage entre deux entreprises dont l\u2019une avait vu partir un grand nombre de ses salari\u00e9s chez sa concurrente.<\/p>\n<p>En effet, dans cette affaire, pour prouver qu\u2019il y avait eu d\u00e9bauchage d\u00e9loyal, l\u2019entreprise qui se disait l\u00e9s\u00e9e avait demand\u00e9 et obtenu du juge des r\u00e9f\u00e9r\u00e9s l\u2019autorisation d\u2019analyser le contenu des t\u00e9l\u00e9phones portables mis \u00e0 la disposition de ses anciens salari\u00e9s. La soci\u00e9t\u00e9 accus\u00e9e de d\u00e9bauchage contestait cette ordonnance de r\u00e9f\u00e9r\u00e9.<\/p>\n<p>Pour la chambre commerciale de la Cour de cassation, les \u00ab SMS \u00bb envoy\u00e9s ou re\u00e7us par le salari\u00e9 au moyen du t\u00e9l\u00e9phone mis \u00e0 sa disposition par l\u2019employeur pour les besoins de son travail sont pr\u00e9sum\u00e9s avoir un caract\u00e8re professionnel, en sorte que l\u2019employeur est en droit de les consulter en dehors de la pr\u00e9sence de l\u2019int\u00e9ress\u00e9, sauf s\u2019ils sont identifi\u00e9s comme \u00e9tant personnels.<\/p>\n<p>En cons\u00e9quence, les \u00ab SMS \u00bb n\u2019ayant pas \u00e9t\u00e9 identifi\u00e9s comme personnels peuvent \u00eatre produits en justice sans que cela ne constitue un proc\u00e9d\u00e9 d\u00e9loyal. En d\u00e9finitive, la Cour de cassation transpose aux \u00ab SMS \u00bb sa jurisprudence \u00e9labor\u00e9e pour les courriels.<\/p>\n<p>Enfin, signalons qu\u2019avant de statuer ainsi, la chambre commerciale de la Cour de cassation avait pris le soin de recueillir l\u2019avis de la chambre sociale.
