Il a donc saisi les juges du fond pour faire juger son licenciement sans cause r\u00e9elle et s\u00e9rieuse et obtenir des dommages et int\u00e9r\u00eats.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La cour d\u2019appel ne lui a pas donn\u00e9 gain de cause, estimant que les \u00e9l\u00e9ments avanc\u00e9s par l\u2019employeur indiquaient que l\u2019employeur avait d\u00fb pallier son absence par une organisation interne et le remplacer \u00e0 titre d\u00e9finitif. Selon les juges du fond, ces \u00e9l\u00e9ments \u00e9taient suffisants pour consid\u00e9rer que le licenciement \u00e9tait r\u00e9el et s\u00e9rieux.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation n\u2019approuve pas le raisonnement retenu par les juges du fond.
