Le salari\u00e9 peut ainsi appr\u00e9cier l\u2019emploi pour lequel il a \u00e9t\u00e9 recrut\u00e9<small>&nbsp;<\/small>; l\u2019employeur peut \u00e9valuer les comp\u00e9tences du salari\u00e9.<\/p>\n\n\n\n<p>Elle n\u2019est valable que si elle est express\u00e9ment stipul\u00e9e dans le contrat de travail (ou la lettre d\u2019engagement) sign\u00e9 par le salari\u00e9 et ne peut exister qu\u2019au d\u00e9but de la relation de travail pour un m\u00eame poste.<\/p>\n\n\n\n<p>En g\u00e9n\u00e9ral, sa dur\u00e9e est pr\u00e9vue par les accords collectifs qui s\u2019appliquent dans l\u2019entreprise. Pour les CDI, la p\u00e9riode d\u2019essai initiale ne peut pas d\u00e9passer deux mois pour les ouvriers et employ\u00e9s, trois mois pour les agents de ma\u00eetrise et techniciens, quatre mois pour les cadres.<\/p>\n\n\n\n<p>Attention, la p\u00e9riode d\u2019essai peut \u00eatre renouvel\u00e9e uniquement si le contrat et un accord de branche \u00e9tendu le pr\u00e9voient.<\/p>\n\n\n\n<p>La dur\u00e9e peut alors \u00eatre doubl\u00e9e.<\/p>\n\n\n\n<p>Elle s\u2019ach\u00e8ve, en toute logique, soit par la poursuite du contrat, soit par sa rupture.<\/p>\n\n\n\n<p>La rupture de la p\u00e9riode d\u2019essai est libre et n\u2019a pas besoin d\u2019\u00eatre motiv\u00e9e. Il ne s\u2019agit ni d\u2019une d\u00e9mission, ni d\u2019un licenciement. Le salari\u00e9 comme l\u2019employeur doivent respecter un d\u00e9lai entre l\u2019annonce du souhait de rompre le contrat et l\u2019arriv\u00e9e \u00e0 terme de la p\u00e9riode d\u2019essai. C\u2019est le d\u00e9lai de pr\u00e9venance (entre 24h et 48h en fonction du temps de pr\u00e9sence du salari\u00e9 dans l\u2019entreprise).
