C&rsquo;est un droit fondamental pr\u00e9vu par la Constitution.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Faut-il d\u00e9poser un pr\u00e9avis ?<\/mark><\/strong><\/p>\n\n\n\n<p>Dans le secteur priv\u00e9, la loi n&rsquo;impose aucun pr\u00e9avis.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Si je fais gr\u00e8ve, est-ce que je dois avertir mon employeur ?<\/mark><\/strong><\/p>\n\n\n\n<p>Il n&rsquo;existe aucun d\u00e9lai de pr\u00e9venance de l&#8217;employeur. En th\u00e9orie, le salari\u00e9 peut se d\u00e9clarer gr\u00e9viste le matin m\u00eame ou une fois de retour au travail \u00e0 l&rsquo;issue de la mobilisation.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Quelle est la d\u00e9marche \u00e0 suivre ?<\/mark><\/strong><\/p>\n\n\n\n<p>La d\u00e9marche \u00e0 suivre est d&rsquo;avertir la(le) manager et la(le) RH par mail en indiquant&nbsp;par exemple :<\/p>\n\n\n\n<p>\u00ab\u00a0<em>Suite au mouvement de gr\u00e8ve nationale, je vous informe que le &lt;date> \u00e0 partir de &lt;heure>, je serai en gr\u00e8ve.<\/em>\u00ab\u00a0<\/p>\n\n\n\n<p>Vous pouvez \u00eatre en gr\u00e8ve toute la journ\u00e9e, comme juste quelques heures, \u00e0 vous de d\u00e9finir la dur\u00e9e. Pendant la dur\u00e9e de la gr\u00e8ve, votre salaire n&rsquo;est pas maintenu.<\/p>\n\n\n\n<p>A votre retour au travail, envoyez un mail au manager et au RH en indiquant par exemple :<\/p>\n\n\n\n<p>\u00ab\u00a0<em>Je suis revenu \u00e0 mon travail \u00e0 &lt;heure&gt;.<\/em>\u00ab\u00a0<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Est-ce que je peux \u00eatre sanctionn\u00e9 pour avoir fait gr\u00e8ve ?<\/mark><\/strong><\/p>\n\n\n\n<p>Aucun travailleur ne peut subir de sanction ou de discrimination pour avoir fait gr\u00e8ve dans les conditions l\u00e9gales. <\/p>\n\n\n\n<p>La retenue sur la r\u00e9mun\u00e9ration doit \u00eatre proportionnelle \u00e0 la dur\u00e9e de l&rsquo;arr\u00eat de travail.
