{"id":4643,"date":"2023-07-06T07:44:00","date_gmt":"2023-07-06T06:44:00","guid":{"rendered":"http:\/\/foastek.fr\/?p=4643"},"modified":"2023-07-03T18:45:46","modified_gmt":"2023-07-03T17:45:46","slug":"dispense-du-preavis","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=4643","title":{"rendered":"Dispense du pr\u00e9avis"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Dans certains cas de rupture du contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, le salari\u00e9 doit un pr\u00e9avis&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Lors du licenciement (hors faute grave ou lourde)<\/li>\n\n\n\n<li>Lors de la d\u00e9mission (quand la loi, la convention collective ou les usages le pr\u00e9voient)<\/li>\n\n\n\n<li>Lors du d\u00e9part volontaire \u00e0 la retraite et de la mise \u00e0 la retraite<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Dans tous ces cas, une dispense de pr\u00e9avis est possible. Elle n&rsquo;a pas lieu d&rsquo;\u00eatre pour les ruptures de contrat sans pr\u00e9avis comme le licenciement pour inaptitude ou la rupture conventionnelle individuelle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Demandeur de la dispense<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dispense \u00e0 l&rsquo;initiative de l&#8217;employeur<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019employeur peut d\u00e9cider de dispenser le salari\u00e9 d\u2019effectuer son pr\u00e9avis. La dispense \u00e0 l&rsquo;initiative de l&#8217;employeur s\u2019impose au salari\u00e9 sans qu&rsquo;il y ait \u00e0 recueillir son accord (cass. soc. 13 juillet 2004, n\u00b0 <a href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=JURI&amp;orig=REVUE_RF_FH&amp;juridiction=CASS&amp;chambre=SOC.&amp;numero=02-14140&amp;sp=\/juri\/cass\/global\/sociale\/JURI\/TEXT\/00\/00\/07\/04\/69\/JURITEXT000007046957.xml&amp;date=2004-07-13\" rel=\"noreferrer noopener\" target=\"_blank\">02-14140<\/a>, BC V n\u00b0 208). De son c\u00f4t\u00e9, l&#8217;employeur est tenu par sa d\u00e9cision une fois celle-ci \u00e9nonc\u00e9e. Il ne peut pas se raviser et finalement demander au salari\u00e9 de travailler. C&rsquo;est par exemple le cas lorsque sa d\u00e9cision figure dans la notification d&rsquo;un licenciement (cass. soc. 22 octobre 2008, n\u00b0 <a href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=JURI&amp;orig=REVUE_RF_FH&amp;juridiction=CASS&amp;chambre=SOC.&amp;numero=07-42140&amp;sp=\/juri\/cass\/global\/sociale\/JURI\/TEXT\/00\/00\/19\/87\/97\/JURITEXT000019879709.xml&amp;date=2008-10-22\" rel=\"noreferrer noopener\" target=\"_blank\">07-42140<\/a>, BC V n\u00b0 199).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dispense \u00e0 l&rsquo;initiative du salari\u00e9<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Le salari\u00e9 peut demander \u00e0 l\u2019employeur de ne pas ex\u00e9cuter son pr\u00e9avis, par exemple en cas de d\u00e9mission ou de d\u00e9part \u00e0 la retraite. L\u2019employeur est libre d\u2019accepter ou de refuser (cass. soc. 11 octobre 2006, n\u00b0 <a href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=JURI&amp;orig=REVUE_RF_FH&amp;juridiction=CASS&amp;chambre=SOC.&amp;numero=05-45179&amp;sp=\/juri\/inca\/global\/sociale\/JURI\/TEXT\/00\/00\/07\/50\/84\/JURITEXT000007508483.xml&amp;date=2006-10-11\" rel=\"noreferrer noopener\" target=\"_blank\">05-45179<\/a> D).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le salari\u00e9 d\u00e9cidant seul de ne pas ex\u00e9cuter son pr\u00e9avis ou passant outre le refus de son employeur perd le droit \u00e0 son indemnit\u00e9 compensatrice de pr\u00e9avis. L&#8217;employeur peut m\u00eame lui r\u00e9clamer une indemnit\u00e9 \u00e9gale au salaire du temps de pr\u00e9avis, voire des dommages-int\u00e9r\u00eats pour brusque rupture, s\u2019il prouve l\u2019intention de nuire du salari\u00e9 ou un abus manifeste de sa part (cass. soc. 16 novembre 2004, n\u00b0 <a href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=JURI&amp;orig=REVUE_RF_FH&amp;juridiction=CASS&amp;chambre=SOC.&amp;numero=02-46135&amp;sp=\/juri\/inca\/global\/sociale\/JURI\/TEXT\/00\/00\/07\/48\/06\/JURITEXT000007480684.xml&amp;date=2004-11-16\" rel=\"noreferrer noopener\" target=\"_blank\">02-46135<\/a> D).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Type de dispense<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La dispense de pr\u00e9avis peut \u00eatre&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Partielle&nbsp;: le salari\u00e9 en ex\u00e9cute une partie (ex : transfert d&rsquo;informations &#8230;) ;<\/li>\n\n\n\n<li>Totale&nbsp;: le salari\u00e9 ne le travaille pas du tout.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Formalisation de la dispense<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La dispense de pr\u00e9avis doit \u00eatre non \u00e9quivoque. Pour \u00e9viter tout litige, l\u2019employeur doit pr\u00e9ciser par \u00e9crit qu\u2019il dispense ou non le salari\u00e9 de son pr\u00e9avis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Cons\u00e9quences de la dispense<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le contrat de travail se poursuit dans les conditions habituelles&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Jusqu&rsquo;\u00e0 la date de fin convenue entre le salari\u00e9, qui a demand\u00e9 \u00e0 \u00eatre dispens\u00e9 de pr\u00e9avis, et l&#8217;employeur qui a accept\u00e9&nbsp;;<\/li>\n\n\n\n<li>Jusqu&rsquo;\u00e0 la date de fin de pr\u00e9avis, quand l&#8217;employeur prend l&rsquo;initiative de la dispense.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Cong\u00e9s et RTT<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Durant la dispense de pr\u00e9avis d\u00e9cid\u00e9e \u00e0 l\u2019initiative de l\u2019employeur, le salari\u00e9 acquiert des cong\u00e9s pay\u00e9s (c. trav. <a href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L1234-5&amp;idspad=LEGIARTI000006901118\" rel=\"noreferrer noopener\" target=\"_blank\">art. L. 1234-5<\/a>) et des jours de RTT (cass. soc. 14 octobre 2020, n\u00b0 <a href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=JURI&amp;orig=REVUE_RF_FH&amp;juridiction=CASS&amp;chambre=SOC.&amp;numero=19-20399&amp;sp=\/juri\/inca\/global\/sociale\/JURI\/TEXT\/00\/00\/42\/46\/45\/JURITEXT000042464536.xml&amp;date=2020-10-14\" rel=\"noreferrer noopener\" target=\"_blank\">19-20399<\/a> D).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Indemnit\u00e9 compensatrice<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019employeur prenant l\u2019initiative de dispenser le salari\u00e9 d\u2019effectuer son pr\u00e9avis lui verse une indemnit\u00e9 compensatrice jusqu\u2019au terme de celui-ci. \u00c0 l\u2019inverse, si la dispense est accord\u00e9e \u00e0 la demande du salari\u00e9, il n\u2019y a pas d\u2019indemnit\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019indemnit\u00e9 correspond \u00e0 la r\u00e9mun\u00e9ration et aux avantages que le salari\u00e9 aurait per\u00e7us s\u2019il avait effectu\u00e9 son pr\u00e9avis (c. trav. <a href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L1234-5&amp;idspad=LEGIARTI000006901118\" rel=\"noreferrer noopener\" target=\"_blank\">art.
