{"id":4801,"date":"2023-10-27T09:28:27","date_gmt":"2023-10-27T08:28:27","guid":{"rendered":"http:\/\/foastek.fr\/?p=4801"},"modified":"2023-10-27T09:28:30","modified_gmt":"2023-10-27T08:28:30","slug":"enregistrement-de-lemployeur-lors-dun-entretien-prealable-absence-datteinte-a-la-vie-privee","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=4801","title":{"rendered":"Enregistrement de l\u2019employeur lors d\u2019un entretien pr\u00e9alable : absence d\u2019atteinte \u00e0 la vie priv\u00e9e"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">L\u2019article 226-1 du code p\u00e9nal incrimine le fait de capter, enregistrer ou transmettre, sans le consentement de leur auteur, des paroles prononc\u00e9es \u00e0 titre priv\u00e9 ou confidentiel.\u00a0<br><br>Dans une affaire r\u00e9cente, un d\u00e9l\u00e9gu\u00e9 syndical qui assistait un salari\u00e9 \u00e0 un\u00a0entretien pr\u00e9alable au licenciement, a enregistr\u00e9 les propos tenus par le repr\u00e9sentant de l\u2019employeur, \u00e0 son insu. L\u2019employeur a alors attrait le d\u00e9l\u00e9gu\u00e9 syndical devant la juridiction p\u00e9nale en invoquant notamment une atteinte \u00e0 l\u2019intimit\u00e9 de sa vie priv\u00e9e.\u00a0<br><br>Se posait alors la question de savoir si enregistrer l\u2019employeur \u00e0 son insu au cours d\u2019un entretien pr\u00e9alable \u00e9tait susceptible d\u2019engager la responsabilit\u00e9 p\u00e9nale du d\u00e9l\u00e9gu\u00e9 syndical.<br><br>La chambre criminelle de la Cour de cassation r\u00e9pond par la n\u00e9gative.\u00a0Elle rappelle\u00a0que le d\u00e9lit d\u2019atteinte \u00e0 la vie priv\u00e9e ne peut pas \u00eatre retenu \u00e0 l\u2019encontre d\u2019un salari\u00e9 enregistrant son employeur \u00e0 son insu, d\u00e8s lors que l\u2019entretien entre dans le cadre de l\u2019activit\u00e9 professionnelle de l\u2019employeur, quand bien m\u00eame les propos seraient enregistr\u00e9s dans un lieu priv\u00e9.<br><br>Cet arr\u00eat est \u00e0 mettre en relation avec un arr\u00eat du 8 mars 2023 rendu en mati\u00e8re sociale. Si un enregistrement clandestin\u00a0est en principe d\u00e9loyal et la preuve de ce fait irrecevable devant les juridictions civiles\u00a0(Cass. soc., 6 f\u00e9v. 2013, n\u00b011-23738), la Cour de cassation a admis la production d\u2019\u00e9l\u00e9ments portant atteinte \u00e0 la vie personnelle si elle est indispensable \u00e0 l\u2019exercice du droit \u00e0 la preuve et que l\u2019atteinte est strictement proportionn\u00e9e au but poursuivi.
