{"id":4878,"date":"2023-12-12T08:47:46","date_gmt":"2023-12-12T07:47:46","guid":{"rendered":"http:\/\/foastek.fr\/?p=4878"},"modified":"2023-12-08T08:55:05","modified_gmt":"2023-12-08T07:55:05","slug":"prudhommes-les-droits-des-salaries-a-nouveau-pris-pour-cible","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=4878","title":{"rendered":"Prudhommes : les droits des salari\u00e9s \u00e0 nouveau pris pour cible !"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Quelques jours seulement apr\u00e8s avoir souhait\u00e9 remettre en cause la rupture conventionnelle, le ministre de l\u2019Economie, Bruno Lemaire, a d\u00e9clar\u00e9 qu\u2019il pensait n\u00e9cessaire de r\u00e9duire le d\u00e9lai de saisine du Conseil des Prud\u2019hommes par les salari\u00e9s. Il s\u2019agirait de le faire passer d\u2019un an \u00e0 seulement deux mois, pour contester un licenciement. Selon lui, le d\u00e9lai de recours d\u2019un an serait beaucoup trop long.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">FO<\/mark><\/strong><\/em> constate que cette mesure a pour principal objectif de s\u00e9curiser les employeurs en s\u2019en prenant aux droits des salari\u00e9s.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">FO<\/mark><\/strong><\/em> rappelle que depuis les ordonnances travail de 2017, le recours aux Prud\u2019hommes est plus compliqu\u00e9 et que le nombre de saisines est en baisse constante. En 2017, 126 693 nouvelles affaires ont \u00e9t\u00e9 d\u00e9pos\u00e9es devant la juridiction prud\u2019homale contre 100 268 en 2022 soit une diminution de plus de 26%.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">FO<\/mark><\/strong><\/em> estime qu\u2019eu \u00e9gard au choc \u00e9motionnel que peut provoquer un licenciement, il est n\u00e9cessaire de laisser au salari\u00e9 un temps raisonnable de r\u00e9flexion. D\u2019autant plus que le d\u00e9lai de prescription, en mati\u00e8re de licenciement, a d\u00e9j\u00e0 \u00e9t\u00e9 consid\u00e9rablement r\u00e9duit ces derni\u00e8res ann\u00e9es.
