Si ce n\u2019est pas le cas, il est consid\u00e9r\u00e9 comme ayant travaill\u00e9 et ce temps doit lui \u00eatre r\u00e9mun\u00e9r\u00e9.<br><br><strong>Affaire<\/strong><br><br>Dans une affaire jug\u00e9e par la Cour de cassation (7\u00a0f\u00e9vrier 2024), une salari\u00e9e pr\u00e9tendait rester \u00e0 la disposition de son employeur pendant la pause d\u00e9jeuner, puisqu\u2019elle devait accueillir les clientes au t\u00e9l\u00e9phone et physiquement. Elle r\u00e9clamait en cons\u00e9quence que ce temps soit requalifi\u00e9 en temps de travail effectif.<br><br>La Cour de cassation a rappel\u00e9 les dispositions applicables\u00a0:<br>&#8211; la d\u00e9finition du temps de travail effectif (c. trav. art. L. 3121-1\u00a0: \u00ab\u00a0temps pendant lequel le salari\u00e9 est \u00e0 la disposition de l&#8217;employeur et se conforme \u00e0 ses directives sans pouvoir vaquer librement \u00e0 des occupations personnelles\u00a0\u00bb)\u00a0;<br>&#8211; la r\u00e8gle selon laquelle le temps n\u00e9cessaire \u00e0 la restauration ainsi que les temps consacr\u00e9s aux pauses sont consid\u00e9r\u00e9s comme du temps de travail effectif si les crit\u00e8res en sont remplis (c. trav. art. L. 3121-2).<br><br>Tout \u00e9tant affaire de circonstances, les juges doivent en pratique \u00e0 chaque fois rechercher si les crit\u00e8res du travail effectif sont remplis.<br><br>La Cour de cassation reproche aux juges d\u2019appel d\u2019avoir d\u00e9bout\u00e9e la salari\u00e9e de ses demandes sans avoir recherch\u00e9 si elle \u00e9tait, durant ses temps de pause, \u00e0 la disposition de l&#8217;employeur et devait se conformer \u00e0 ses directives sans pouvoir vaquer librement \u00e0 des occupations personnelles.<br><br>L\u2019affaire doit donc \u00eatre rejug\u00e9e sur ce point.<br><br>&#x1f4cc; Cass. soc. 7 f\u00e9vrier 2024, n\u00b0 22-22308 FD<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>R\u00e9sum\u00e9 Durant ses pauses, pause d\u00e9jeuner comprise, le salari\u00e9 doit cesser son activit\u00e9 et \u00eatre en mesure de vaquer \u00e0 ses occupations.
