L. 3131-1). Un accord d\u2019entreprise ou d\u2019\u00e9tablissement (\u00e0 d\u00e9faut, une convention ou un accord de branche), peut d\u00e9roger \u00e0 la dur\u00e9e minimale de 11 heures, dans un sens plus d\u00e9favorable au salari\u00e9, sous conditions (c. trav. art. L. 3131-2).<br><br>L\u2019employeur doit s\u2019assurer de l\u2019effectivit\u00e9 du repos quotidien des salari\u00e9s et ainsi prendre les mesures n\u00e9cessaires pour assurer la s\u00e9curit\u00e9 des salari\u00e9s et prot\u00e9ger leur sant\u00e9 physique et mentale, notamment par la mise en place d&rsquo;une organisation et de moyens adapt\u00e9s (c. trav. art. L. 4121-1).<br><br><strong>Affaire<\/strong><br><br>Un salari\u00e9 a demand\u00e9 la r\u00e9siliation de son contrat de travail et le paiement de diverses sommes au titre de l&rsquo;ex\u00e9cution et de la rupture de son contrat de travail. Il r\u00e9clame notamment \u00e0 son employeur des dommages-int\u00e9r\u00eats pour manquement \u00e0 son obligation de s\u00e9curit\u00e9 li\u00e9e au non-respect des temps de repos entre deux p\u00e9riodes de travail.<br><br>La cour d\u2019appel a effectivement constat\u00e9 qu&rsquo;\u00e0 plusieurs reprises le salari\u00e9 n&rsquo;a pas b\u00e9n\u00e9fici\u00e9 du repos de 12 heures entre deux services au cours de plusieurs ann\u00e9es, mais a retenu que le salari\u00e9 ne justifie d&rsquo;aucun pr\u00e9judice sp\u00e9cifique.<br><br>La Cour de cassation casse la d\u00e9cision de la cour d\u2019appel et rappelle que le non-respect de la dur\u00e9e de repos quotidien des salari\u00e9s ouvre automatiquement droit, en cas de contentieux, \u00e0 des dommages-int\u00e9r\u00eats.<br><br>&#x1f4cc; Cass. soc. 7 f\u00e9vrier 2024, n\u00b0 21-22809 et 21-22994 (jonction) FSB<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>Rappel Un salari\u00e9 doit b\u00e9n\u00e9ficier d\u2019un repos quotidien d\u2019une dur\u00e9e minimale de 11 heures cons\u00e9cutives (c. trav. art.
