C\u2019est le principe, souvent invoqu\u00e9 dans les contentieux, \u00ab \u00e0 travail \u00e9gal, salaire \u00e9gal \u00bb (cass. soc. 29 octobre 1996, n\u00b0 92-43680, BC V n\u00b0 359 ; cass. soc. 15 d\u00e9cembre 1998, n\u00b0 95-43630, BC V n\u00b0 551). Pour que ce principe puisse jouer, il faut bien entendu que les situations soient comparables.<\/p>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Affaire<\/span><\/strong><\/p>\n\n\n\n<p>Un employeur avait \u00e9t\u00e9 condamn\u00e9 \u00e0 payer \u00e0 un salari\u00e9, reconnu travailleur handicap\u00e9, des dommages-int\u00e9r\u00eats pour discrimination salariale.<\/p>\n\n\n\n<p>L\u2019employeur avait tent\u00e9 de justifier la diff\u00e9rence de traitement entre les deux salari\u00e9s par la qualit\u00e9 de r\u00e9f\u00e9rent technique [&#8230;], ce que n\u2019\u00e9tait pas le salari\u00e9 s\u2019estimant discrimin\u00e9. Selon l\u2019employeur, la cour d\u2019appel n\u2019avait pas constat\u00e9 que la discrimination invoqu\u00e9e \u00e9tait pr\u00e9sum\u00e9e du fait du handicap du salari\u00e9.<\/p>\n\n\n\n<p>La cour d\u2019appel a estim\u00e9 que l&#8217;employeur n&rsquo;\u00e9tablissait pas que le salari\u00e9, dont la r\u00e9mun\u00e9ration \u00e9tait sup\u00e9rieure (de 10 cts\/heure) \u00e0 celle du salari\u00e9 en situation de handicap, avait la qualit\u00e9 de r\u00e9f\u00e9rent qui justifierait la diff\u00e9rence de traitement.<\/p>\n\n\n\n<p>La Cour de cassation n&rsquo;a pas retenu les arguments de l\u2019employeur.
