{"id":5079,"date":"2024-04-22T07:31:00","date_gmt":"2024-04-22T06:31:00","guid":{"rendered":"http:\/\/foastek.fr\/?p=5079"},"modified":"2024-04-18T12:34:43","modified_gmt":"2024-04-18T11:34:43","slug":"utilisation-de-limage-dun-salarie-pour-une-campagne-publicitaire-de-lentreprise","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=5079","title":{"rendered":"Utilisation de l\u2019image d\u2019un salari\u00e9 pour une campagne publicitaire de l&rsquo;entreprise"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><span style=\"text-decoration: underline;\">R\u00e8gles<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L&#8217;employeur ne peut pas capter, conserver, reproduire ou utiliser l\u2019image du salari\u00e9 sans son accord.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En cas d\u2019atteinte au droit \u00e0 l\u2019image, la r\u00e9paration est automatique, le salari\u00e9 n\u2019a pas \u00e0 d\u00e9montrer de pr\u00e9judice subi (cass. soc. 19 janvier 2022, n\u00b0 20-12420 D).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"text-decoration: underline;\">Affaire<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c0 la suite de son licenciement, un salari\u00e9 a saisi les prud\u2019hommes au sujet de diverses demandes, notamment la violation de son droit \u00e0 l\u2019image.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il reproche \u00e0 son employeur l&rsquo;utilisation son image sans son accord pour r\u00e9aliser une plaquette commerciale diffus\u00e9e aupr\u00e8s des clients de l\u2019entreprise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La cour d\u2019appel a rejet\u00e9 sa demande de dommages et int\u00e9r\u00eats au motif que le salari\u00e9 ne produisait pas le document critiqu\u00e9, ce qui l\u2019emp\u00eachait d\u2019appr\u00e9cier la r\u00e9alit\u00e9 de l\u2019atteinte au droit \u00e0 l\u2019image invoqu\u00e9e.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation a censur\u00e9 cette d\u00e9cision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L&#8217;employeur n&rsquo;a pas contest\u00e9 avoir utilis\u00e9 l\u2019image du salari\u00e9 pour r\u00e9aliser une plaquette adress\u00e9e aux clients. \u00c0 partir du moment o\u00f9 le salari\u00e9 fait valoir qu\u2019il n\u2019a pas donn\u00e9 son accord \u00e0 cette utilisation, la cour d\u2019appel devait faire droit \u00e0 sa demande de r\u00e9paration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#x1f4cc; Cass. soc. 14 f\u00e9vrier 2024, n\u00b0 22-18014 D<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>R\u00e8gles L&#8217;employeur ne peut pas capter, conserver, reproduire ou utiliser l\u2019image du salari\u00e9 sans son accord.
