{"id":5081,"date":"2024-04-19T07:48:00","date_gmt":"2024-04-19T06:48:00","guid":{"rendered":"http:\/\/foastek.fr\/?p=5081"},"modified":"2024-04-18T12:50:58","modified_gmt":"2024-04-18T11:50:58","slug":"informer-le-salarie-de-son-licenciement-par-telephone-avant-que-la-lettre-soit-envoyee-rend-le-licenciement-sans-cause-reelle-et-serieuse","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=5081","title":{"rendered":"Informer le salari\u00e9 de son licenciement par t\u00e9l\u00e9phone avant que la lettre soit envoy\u00e9e rend le licenciement sans cause r\u00e9elle et s\u00e9rieuse"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><span style=\"text-decoration: underline;\">Affaire<\/span><br><br>Un salari\u00e9 pr\u00e9tend avoir fait l&rsquo;objet d&rsquo;un licenciement verbal le jour de l&rsquo;envoi de la lettre de rupture.<br><br>En effet, l&#8217;employeur lui a notifi\u00e9 son licenciement par LRAR et le jour m\u00eame l&#8217;employeur (en l\u2019occurrence la DRH) l&rsquo;a appel\u00e9 au t\u00e9l\u00e9phone en lui faisant part de son licenciement avant l&rsquo;envoi de la lettre de licenciement.<br><br>La cour d\u2019appel a relev\u00e9 que\u00a0:<br>&#8211; le salari\u00e9 rapporte la preuve qu&rsquo;il a \u00e9t\u00e9 inform\u00e9 verbalement de son licenciement, \u00e0 l&rsquo;occasion d&rsquo;une conversation t\u00e9l\u00e9phonique avec la DRH de l&rsquo;entreprise\u00a0;<br>&#8211; l&#8217;employeur faisait valoir \u00ab\u00a0<em>qu&rsquo;il \u00e9tait convenable pour la soci\u00e9t\u00e9 de pr\u00e9venir l&rsquo;int\u00e9ress\u00e9 de son licenciement par t\u00e9l\u00e9phone le jour m\u00eame de l&rsquo;envoi de la lettre de licenciement, afin de lui \u00e9viter de se pr\u00e9senter \u00e0 une r\u00e9union et de se voir cong\u00e9dier devant ses coll\u00e8gues de travail<\/em>\u00a0\u00bb.<br><br>La cour en a conclu qu\u2019il s\u2019agit d\u2019un licenciement verbal. L\u2019appel t\u00e9l\u00e9phonique de la DRH ne peut pas suppl\u00e9er la lettre de licenciement adress\u00e9e ult\u00e9rieurement, m\u00eame si elle a \u00e9t\u00e9 adress\u00e9e le m\u00eame jour, sous la signature de la personne auteur de l&rsquo;appel t\u00e9l\u00e9phonique.<br><br>Lorsque l\u2019employeur a proc\u00e9d\u00e9 \u00e0 un licenciement verbal, il ne peut pas se rattraper. Il est inutile, d\u2019adresser un \u00e9crit au salari\u00e9 a posteriori (cass. soc. 9 mars 2011, n\u00b0 09-65441 D).<br><br>La Cour de cassation souligne que l\u2019appel t\u00e9l\u00e9phonique pass\u00e9 par la DRH ne peut pas suppl\u00e9er la lettre de licenciement adress\u00e9e ult\u00e9rieurement. Peu importe que cet envoi ait eu lieu le m\u00eame jour et que la lettre de notification soit sign\u00e9e de la DRH.<br><br>Le licenciement verbal est donc, comme cela est toujours jug\u00e9 (cass. soc. 6 f\u00e9vrier 2013, n\u00b0 11-23738, BC V n\u00b0 31), un licenciement sans cause r\u00e9elle et s\u00e9rieuse.<br><br>&#x1f4cc; Cass. soc. 3 avril 2024, n\u00b0 23-10931 FD<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>Affaire Un salari\u00e9 pr\u00e9tend avoir fait l&rsquo;objet d&rsquo;un licenciement verbal le jour de l&rsquo;envoi de la lettre de rupture.
