R\u00e8gle<\/span><br><br>L\u2019employeur doit assurer un repos quotidien d\u2019une dur\u00e9e minimale de 11 heures cons\u00e9cutives aux salari\u00e9s, y compris ceux en forfait annuel en jours (c. trav. art. L. 3131-1 et L. 3121-62).<br><br>Le d\u00e9but du repos correspond \u00e0 la fin du service du salari\u00e9 (cass. soc. 27 juin 2012, n\u00b0 10-21306, BC V n\u00b0 201).<br><br>En cas d\u2019astreinte sans intervention, la p\u00e9riode d\u2019astreinte est prise en compte pour le calcul de la dur\u00e9e de 11 heures (c. trav. art. L. 3121-10).<br><br><span style=\"text-decoration: underline;\">2. Non-respect<\/span><br><br>En cas de litige sur le respect du repos quotidien, la charge de la preuve repose uniquement sur l\u2019employeur (cass. soc. 6 f\u00e9vrier 2019, n\u00b0 17-28769 D).<br><br>De plus, le seul constat que le salari\u00e9 n\u2019a pas b\u00e9n\u00e9fici\u00e9 du repos journalier entre deux services lui ouvre droit \u00e0 r\u00e9paration, sans qu\u2019il ait \u00e0 d\u00e9montrer un pr\u00e9judice (cass. soc. 7 f\u00e9vrier 2024, n\u00b0 21-22809 FSB).<br><br>&#x1f449; D\u00e9rogations<br><br>Une convention ou un accord de branche, d\u2019entreprise ou d\u2019\u00e9tablissement peut d\u00e9roger aux 11 heures minimum de repos quotidien (c. trav. art. L. 3131-2, D. 3131-4 et D. 3131-5) :<br>\u2022 pour les salari\u00e9s n\u00e9cessitant d\u2019assurer une continuit\u00e9 du service ou de production, une garde et une surveillance assurant la protection des biens et des personnes) ;<br>\u2022 en cas de surcro\u00eet d\u2019activit\u00e9.<br><br>La dur\u00e9e du repos quotidien doit \u00eatre au minimum de 9 heures (c. trav. art. D. 3131-6).<br><br><span style=\"text-decoration: underline;\">1. Travaux urgents<\/span><br><br>L\u2019employeur peut d\u00e9roger aux 11 heures de repos quotidien en cas de travaux urgents dont l\u2019ex\u00e9cution imm\u00e9diate est n\u00e9cessaire pour organiser des mesures de sauvetage, pr\u00e9venir des accidents imminents ou r\u00e9-parer des accidents survenus au mat\u00e9riel, aux installations ou aux b\u00e2timents (c. trav. art. D. 3131-1). Il doit en informer l\u2019inspecteur du travail.<br><br><span style=\"text-decoration: underline;\">2. Surcro\u00eet d\u2019activit\u00e9<\/span><br><br>En\u00a0l\u2019absence d\u2019accord collectif sur ce sujet, l\u2019employeur peut d\u00e9roger au repos quotidien en cas de surcro\u00eet exceptionnel d\u2019activit\u00e9, sur autorisation de l\u2019inspecteur du travail. Pour cela, il lui faut au pr\u00e9alable recueillir l\u2019avis du CSE, qu\u2019il doit joindre \u00e0 sa demande (c. trav. art. L. 3131-3 et D. 3131-7). En cas d\u2019urgence, il peut r\u00e9duire la dur\u00e9e du repos quotidien sous sa seule responsabilit\u00e9, \u00e0 condition de pr\u00e9senter imm\u00e9diatement une demande de r\u00e9gularisation \u00e0 l\u2019inspecteur du travail<br><br><span style=\"text-decoration: underline;\">3. Compensation<\/span><br><br>Dans toutes ces d\u00e9rogations, les salari\u00e9s concern\u00e9s doivent b\u00e9n\u00e9ficier d\u2019une p\u00e9riode de repos au moins \u00e9quivalente, ou, lorsque cela est impossible, d\u2019une contrepartie \u00e9quivalente pr\u00e9vue par un accord collectif (c. trav. art.
