{"id":5156,"date":"2024-06-11T10:53:34","date_gmt":"2024-06-11T09:53:34","guid":{"rendered":"http:\/\/foastek.fr\/?p=5156"},"modified":"2024-06-11T10:53:37","modified_gmt":"2024-06-11T09:53:37","slug":"laction-en-justice-du-syndicat-pour-defendre-linteret-collectif-de-la-profession","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=5156","title":{"rendered":"L\u2019action en justice du syndicat pour d\u00e9fendre l\u2019int\u00e9r\u00eat collectif de la profession"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Le syndicat peut intenter une action en justice en usant de trois biais :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>la d\u00e9fense de ses int\u00e9r\u00eats propres ;<\/li>\n\n\n\n<li>dans certains cas limitativement \u00e9num\u00e9r\u00e9s, la d\u00e9fense des int\u00e9r\u00eats personnels du salari\u00e9 (via l\u2019action de substitution) ;<\/li>\n\n\n\n<li>la d\u00e9fense de l\u2019int\u00e9r\u00eat collectif de la profession d\u00e9fendue par le syndicat (art. L 2132-3).<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation a r\u00e9cemment proc\u00e9d\u00e9 \u00e0 deux \u00ab piqures de rappel \u00bb sur cette troisi\u00e8me possibilit\u00e9 d\u2019action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Et pour cause, dans ces contentieux, la premi\u00e8re strat\u00e9gie judiciaire mobilis\u00e9e par les employeurs est de soulever l\u2019irrecevabilit\u00e9 de l\u2019action en justice du syndicat (pour d\u00e9faut d\u2019int\u00e9r\u00eat \u00e0 agir) au motif que la probl\u00e9matique soulev\u00e9e ne rel\u00e8ve pas de l\u2019int\u00e9r\u00eat collectif de la profession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La fronti\u00e8re entre l\u2019atteinte \u00e0 l\u2019int\u00e9r\u00eat individuel du salari\u00e9 et l\u2019atteinte \u00e0 l\u2019int\u00e9r\u00eat collectif n\u2019est pas toujours ais\u00e9e :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sur la forme, il est fr\u00e9quent que les yndicat,\u00ab se greffe \u00bb \u00e0 l\u2019action intent\u00e9e individuellement par le salari\u00e9 en usant de la voie de l\u2019intervention volontaire afin d\u2019obtenir des dommages et int\u00e9r\u00eats ;<\/li>\n\n\n\n<li>sur le fond, des m\u00eames faits peuvent concerner \u00e0 la fois l\u2019int\u00e9r\u00eat individuel du salari\u00e9 et l\u2019int\u00e9r\u00eat collectif de la profession. La faiblesse du nombre de salari\u00e9s concern\u00e9s par l\u2019irr\u00e9gularit\u00e9 est sans incidence. Seul compte l\u2019enjeu de la question pos\u00e9e au juge (application d\u2019une convention collective, respect de la sant\u00e9 et de la s\u00e9curit\u00e9 au travail, etc.).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Dans la premi\u00e8re d\u00e9cision (Cass. soc., 29-5-24, n\u00b022-16433 et n\u00b022-18145), la Cour de cassation rappelle que : \u00ab la violation [\u2026] des dispositions relatives \u00e0 l&rsquo;interdiction de toute discrimination syndicale est de nature \u00e0 porter un pr\u00e9judice \u00e0 l&rsquo;int\u00e9r\u00eat collectif de la profession \u00bb. Il s\u2019agit d\u2019une confirmation de jurisprudence (en ce sens, Cass. soc., 13-1-21, n\u00b019-17182).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En effet, la prohibition de la discrimination syndicale permet de garantir la libert\u00e9 syndicale et touche, de ce fait, \u00e0 l\u2019int\u00e9r\u00eat collectif de la profession.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans la seconde d\u00e9cision (Cass. soc., 29-5-24, n\u00b022-19811), il s\u2019agissait d\u2019une entreprise ayant mal appliqu\u00e9 les coefficients de r\u00e9mun\u00e9ration d\u2019une convention collective \u00e0 un salari\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation rappelle qu\u2019entre dans le concept d\u2019int\u00e9r\u00eat collectif de la profession permettant au syndicat d\u2019agir en justice, \u00ab l&rsquo;existence d&rsquo;une irr\u00e9gularit\u00e9 commise par l&#8217;employeur au regard de dispositions l\u00e9gales, r\u00e9glementaires ou conventionnelles \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour \u00eatre recevable \u00e0 agir \u00e0 ce titre, le syndicat doit toutefois \u00eatre vigilant \u00e0 la formulation de sa demande. S\u2019il peut demander l&rsquo;application d&rsquo;une convention ou d&rsquo;un accord collectif et demander l&rsquo;allocation de dommages-int\u00e9r\u00eats en r\u00e9paration du pr\u00e9judice ainsi caus\u00e9 \u00e0 l&rsquo;int\u00e9r\u00eat collectif de la profession, il ne peut demander au juge de r\u00e9gulariser la situation individuelle d\u2019un salari\u00e9 (par l\u2019octroi d\u2019un rappel de salaire, d\u2019un repositionnement dans le bon coefficient, etc.).
