L\u2019employeur a l\u2019obligation d\u2019affilier le salari\u00e9 titulaire d\u2019un contrat de travail \u00e0 un r\u00e9gime de protection sociale compl\u00e9mentaire (frais de sant\u00e9, pr\u00e9voyance compl\u00e9mentaire et retraite suppl\u00e9mentaire) obligatoire et collectif (c. s\u00e9c. soc. art. L. 911-1 et s.).

La Cour de cassation a estim\u00e9 que l\u2019action du salari\u00e9 \u00e0 l\u2019encontre de son employeur pour d\u00e9faut d\u2019affiliation \u00e0 un r\u00e9gime de pr\u00e9voyance compl\u00e9mentaire d\u2019entreprise est soumise \u00e0 la prescription de droit commun de cinq ans.

Le salari\u00e9 a ainsi pu obtenir de son employeur une somme correspondant \u00e0 la rente conventionnelle d\u2019invalidit\u00e9 qu\u2019il aurait d\u00fb percevoir de l\u2019organisme de pr\u00e9voyance.<\/p>\n\n\n\n
