Pour que l\u2019homologation d\u2019une proc\u00e9dure de rupture conventionnelle soit valid\u00e9e, le consentement est capital ainsi aucune des deux parties (ni l\u2019employeur, ni le salari\u00e9) ne peuvent obliger l\u2019autre \u00e0 signer une rupture conventionnelle.<\/p>\n\n\n\n<p>Le consentement peut \u00eatre consid\u00e9r\u00e9 comme vici\u00e9 par la justice dans le cas o\u00f9 le salari\u00e9 a subi des pressions par exemple. Lorsque le vice de consentement est retenu, cela entraine l\u2019annulation de la convention de rupture et rend \u00e9galement \u00ab la rupture imputable \u00e0 l\u2019employeur et produit les effets d\u2019un licenciement sans cause r\u00e9elle et s\u00e9rieuse \u00bb (arr\u00eat de la Cour de cassation du 16 septembre 2015).<\/p>\n\n\n\n<p><span style=\"text-decoration: underline;\">L&rsquo;affaire<\/span><br>En juin 2024, la Cour de cassation a consid\u00e9r\u00e9 le consentement d\u2019un employeur comme vici\u00e9 lors d\u2019une proc\u00e9dure n\u00e9goci\u00e9e 6 ans plus t\u00f4t. Accordant la rupture conventionnelle \u00e0 l\u2019un de ses responsables commerciaux, une entreprise du secteur automobile a eu la mauvaise surprise de constater l\u2019ann\u00e9e suivante la cr\u00e9ation par ce m\u00eame salari\u00e9 d\u2019une entreprise concurrente\u2026 allant jusqu\u2019\u00e0 recruter d\u2019anciens coll\u00e8gues du salari\u00e9 en question !<\/p>\n\n\n\n<p>Dans son arr\u00eat du 19 juin 2024, la Cour de cassation a constat\u00e9 que \u00ab le salari\u00e9 avait volontairement dissimul\u00e9 des \u00e9l\u00e9ments dont il connaissait le caract\u00e8re d\u00e9terminant pour l\u2019employeur afin d\u2019obtenir le consentement de ce dernier \u00e0 la rupture conventionnelle \u00bb.
