Le juge qui exige plus du salari\u00e9 fait, \u00e0 tort, peser sur lui seul la charge de la preuve.<\/p>\n\n\n\n<p>Lorsqu\u2019un litige sur l\u2019existence ou le nombre d\u2019heures de travail accomplies oppose le salari\u00e9 et l\u2019employeur, la charge de la preuve de la r\u00e9alisation &#8211; ou non r\u00e9alisation &#8211; de ces heures est partag\u00e9e entre eux (c. trav. art. L. 3171-4 ; cass. soc. 18 mars 2020, n\u00b0 18-10919 FPPBRI).<\/p>\n\n\n\n<p>Le salari\u00e9 doit pr\u00e9senter \u00ab des \u00e9l\u00e9ments suffisamment pr\u00e9cis \u00bb \u00e0 l\u2019appui de sa demande (cass. soc. 31 mai 2006, n\u00b0 04-47376, BC V n\u00b0 200).<\/p>\n\n\n\n<p>En retour, l\u2019employeur doit y r\u00e9pondre en produisant ses propres \u00e9l\u00e9ments. Il peut, pour cela, s\u2019appuyer notamment sur les \u00e9l\u00e9ments de d\u00e9compte qui sont en sa possession afin de lui permettre d\u2019assurer le contr\u00f4le des heures de travail effectu\u00e9es (cass. soc. 18 mars 2020, n\u00b0 18-10919 FPPBR).<\/p>\n\n\n\n<p>Au final, c\u2019est le juge qui tranche en se basant sur tous ces \u00e9l\u00e9ments, sachant qu\u2019il peut ordonner des mesures d\u2019instruction s\u2019il les estime utiles. Mais il ne peut pas se prononcer en fonction des seuls \u00e9l\u00e9ments apport\u00e9s par le salari\u00e9, sans que l&#8217;employeur ait eu \u00e0 communiquer ses propres \u00e9l\u00e9ments (c. trav. art. L. 3171-4).<\/p>\n\n\n\n<p>la Cour de cassation souligne que dans un contentieux sur la dur\u00e9e du travail, le juge doit&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>analyser les pi\u00e8ces produites par le salari\u00e9 et l\u2019employeur&nbsp;;<\/li>\n\n\n\n<li>et s\u2019il retient l&rsquo;existence d&rsquo;heures suppl\u00e9mentaires, \u00e9valuer leur importante (sans avoir \u00e0 donner le d\u00e9tail de son calcul) et fixer les cr\u00e9ances salariales qui s&rsquo;y rapportent.<\/li>\n<\/ul>\n\n\n\n<p>Dans cette affaire, pour la Cour de cassation, le salari\u00e9 avait pr\u00e9sent\u00e9 des \u00e9l\u00e9ments suffisamment pr\u00e9cis pour permettre \u00e0 l&#8217;employeur de r\u00e9pondre.<\/p>\n\n\n\n<p>En effet, de jurisprudence constante, il ne s\u2019agit pas pour le salari\u00e9 de prouver l\u2019existence et le nombre exact d\u2019heures qu\u2019il pr\u00e9tend avoir travaill\u00e9 mais de donner suffisamment de mati\u00e8re et de pr\u00e9cision pour que l\u2019employeur soit \u00e0 m\u00eame de r\u00e9pondre.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>R\u00e9f.
