{"id":5660,"date":"2025-05-15T11:16:30","date_gmt":"2025-05-15T10:16:30","guid":{"rendered":"https:\/\/foastek.fr\/?p=5660"},"modified":"2025-06-27T11:20:56","modified_gmt":"2025-06-27T10:20:56","slug":"obligation-de-neutralite-syndicale-de-lemployeur","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=5660","title":{"rendered":"Obligation de neutralit\u00e9 syndicale de l&#8217;employeur"},"content":{"rendered":"\n<p>La Cour d\u2019appel de Paris a confirm\u00e9, le 15 mai 2025, une d\u00e9cision importante en mati\u00e8re de libert\u00e9 syndicale et d\u2019\u00e9galit\u00e9 de traitement.<\/p>\n\n\n\n<p>Affaire : <strong>CA Paris, 15 mai 2025, RG 24\/08802<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Une in\u00e9galit\u00e9 de traitement confirm\u00e9e en appel<\/strong><\/h2>\n\n\n\n<p>Dans cette affaire, le syndicat CGT reprochait \u00e0 l\u2019employeur un traitement moins favorable que celui accord\u00e9 au syndicat majoritaire de l\u2019entreprise, notamment en mati\u00e8re d\u2019acc\u00e8s aux outils de communication et aux moyens syndicaux.<\/p>\n\n\n\n<p>En premi\u00e8re instance, le tribunal judiciaire de Paris a condamn\u00e9 la soci\u00e9t\u00e9 en raison de l\u2019in\u00e9galit\u00e9 de traitement subie par le syndicat et a ordonn\u00e9 \u00e0 l\u2019employeur, sous astreinte, d\u2019accorder aux repr\u00e9sentants et \u00e9lus de la CGT les m\u00eames moyens d\u2019acc\u00e8s \u00e0 l\u2019ensemble des sites de l\u2019entreprise et de mettre \u00e0 disposition de la section syndicale un panneau d\u2019affichage sur chacun de sites (<a href=\"https:\/\/lesjds.com\/la-liberte-syndicale-condamnation\/\">voir notre actu du 16 d\u00e9cembre 2024<\/a>).<\/p>\n\n\n\n<p>R\u00e9futant toute mise en cause de son obligation de neutralit\u00e9, l\u2019employeur a interjet\u00e9 appel du jugement mais le syndicat CGT, repr\u00e9sent\u00e9 par JDS avocats, obtient une nouvelle fois gain de cause en appel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Un signal fort pour le respect des droits syndicaux<\/strong><\/h2>\n\n\n\n<p>Cet arr\u00eat nous rappelle que tout employeur est tenu, en vertu de la libert\u00e9 syndicale, \u00e0 un devoir de neutralit\u00e9 \u00e0 l\u2019\u00e9gard des diff\u00e9rents syndicats pr\u00e9sents au sein de l\u2019entreprise (art. L. 2141-7 CT), que cette disposition est d\u2019ordre public et que toutes mesures prises par l\u2019employeur contraire \u00e0 celle-ci est consid\u00e9r\u00e9e comme abusive et donne lieu \u00e0 des dommages-int\u00e9r\u00eats.<\/p>\n\n\n\n<p>Ainsi, les outils num\u00e9riques disponibles dans l\u2019entreprise ne peuvent, sans porter atteinte au principe d\u2019\u00e9galit\u00e9 de traitement en mati\u00e8re de communication syndicale, \u00eatre r\u00e9serv\u00e9s \u00e0 un seul syndicat d\u00e8s lors que l\u2019affichage et la diffusion des communications syndicales \u00e0 l\u2019int\u00e9rieur de l\u2019entreprise sont li\u00e9s \u00e0 la constitution par les organisations syndicales d\u2019une section syndicale \u00e0 d\u00e9faut de tout autre condition si ce n\u2019est le fait d\u2019\u00eatre pr\u00e9sente dans l\u2019entreprise.<\/p>\n\n\n\n<p>La Cour d\u2019appel confirme par cons\u00e9quent que la diff\u00e9rence de traitement subie par la CGT constituait une violation manifeste de l\u2019obligation de neutralit\u00e9 de l\u2019employeur, en particulier \u00e0 l\u2019approche d\u2019\u00e9lections professionnelles et condamne celui-ci \u00e0 r\u00e9parer le pr\u00e9judice subi par le syndicat.<\/p>\n\n\n\n<p>Source : <a href=\"https:\/\/lesjds.com\/obligation-de-neutralite-syndicale\/\">Employeur m\u00e9connaissant son obligation de neutralit\u00e9 syndicale \u2013 Les JDS<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>La Cour d\u2019appel de Paris a confirm\u00e9, le 15 mai 2025, une d\u00e9cision importante en mati\u00e8re de libert\u00e9 syndicale et d\u2019\u00e9galit\u00e9 de traitement.
