Lorsqu\u2019un salari\u00e9 fait l\u2019objet de reproches fond\u00e9s sur des t\u00e9moignages \u00e9manant de coll\u00e8gues<br>souhaitant rester anonymes, ces \u00e9l\u00e9ments peuvent d\u00e9sormais \u00eatre pris en compte lors d\u2019un contentieux prud\u2019homal sous certaines conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Les faits<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un salari\u00e9 licenci\u00e9 pour faute grave contestait la validit\u00e9 de deux constats d\u2019huissier contenant des t\u00e9moignages anonymes qui d\u00e9non\u00e7aient son comportement agressif. La Cour d\u2019appel avait \u00e9cart\u00e9 les t\u00e9moignages anonymis\u00e9s et jug\u00e9 le licenciement sans cause r\u00e9elle et s\u00e9rieuse, faute pour l\u2019employeur<br>d\u2019avoir fourni d\u2019autres pi\u00e8ces que les t\u00e9moignages anonymes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>La Cour de cassation casse le jugement de la Cour d\u2019appel et apporte une nouvelle pierre \u00e0 sa jurisprudence<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les hauts magistrats consid\u00e8rent qu\u2019il revient au juge d\u2019appr\u00e9cier, dans chaque cas, si l\u2019anonymisation est justifi\u00e9e et proportionn\u00e9e \u00e0 l\u2019objectif poursuivi, notamment \u00e0 la lumi\u00e8re des principes du droit \u00e0 un proc\u00e8s \u00e9quitable et du droit \u00e0 la preuve. La Cour de cassation consid\u00e8re que le droit \u00e0 la preuve peut justifier la production d\u2019\u00e9l\u00e9ments portant atteinte au principe d\u2019\u00e9galit\u00e9 des armes, \u00e0 condition que cette production soit indispensable \u00e0 son exercice, que l\u2019atteinte soit strictement proportionn\u00e9e au but poursuivi. Elle rappelle que l\u2019utilisation de t\u00e9moignages anonymes peut \u00eatre admise d\u00e8s lors qu\u2019elle r\u00e9pond \u00e0 une n\u00e9cessit\u00e9 imp\u00e9rieuse, comme la protection de la sant\u00e9 ou de la s\u00e9curit\u00e9 des salari\u00e9s t\u00e9moins. La Cour<br>souligne que plusieurs \u00e9l\u00e9ments de contexte doivent \u00eatre pris en consid\u00e9ration :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les t\u00e9moignages ont \u00e9t\u00e9 recueillis par un huissier de justice dans des conditions garantissant leur fiabilit\u00e9 ;<\/li>\n\n\n\n<li>la gravit\u00e9 des faits reproch\u00e9s (violences, menaces, intimidations) justifiait la crainte l\u00e9gitime des t\u00e9moins ;<\/li>\n\n\n\n<li>en vertu de son obligation de s\u00e9curit\u00e9 (C. trav., art.
