{"id":5754,"date":"2025-08-29T11:22:10","date_gmt":"2025-08-29T10:22:10","guid":{"rendered":"https:\/\/foastek.fr\/?p=5754"},"modified":"2025-09-01T11:28:33","modified_gmt":"2025-09-01T10:28:33","slug":"astek-proposition-de-signature-dun-proces-verbal-de-desaccord-sur-la-negociation-des-salaires","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=5754","title":{"rendered":"[Astek] Proposition de signature d&rsquo;un proc\u00e8s-verbal de d\u00e9saccord sur la n\u00e9gociation des salaires"},"content":{"rendered":"\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong><em>FO<\/em><\/strong><\/mark> a r\u00e9pondu d\u00e9favorable \u00e0 la signature en raison de l&rsquo;absence totale de prise en compte de ses revendications.<\/p>\n\n\n\n<p>Compte tenu du d\u00e9roul\u00e9 des r\u00e9unions de n\u00e9gociation, <strong><em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">FO<\/mark><\/em><\/strong> a souhait\u00e9 rappeler \u00e0 l&#8217;employeur quelques r\u00e8gles fondamentales sur la r\u00e9daction d&rsquo;un proc\u00e8s-verbal de d\u00e9saccord.<\/p>\n\n\n\n<p><em>Conform\u00e9ment \u00e0 l\u2019article L.2242-5 du Code du travail, un PV de d\u00e9saccord doit consigner \u00ab\u00a0en leur dernier \u00e9tat, les propositions respectives des parties ainsi que les mesures que l\u2019employeur entend appliquer unilat\u00e9ralement\u202f\u00a0\u00bb. Or, le document actuel ne reprend ni les propositions de la Direction, ni ses r\u00e9ponses aux n\u00f4tres, mais uniquement des mesures unilat\u00e9rales et les propositions des organisations syndicales repr\u00e9sentatives. La Direction \u00e9tant partie \u00e0 la n\u00e9gociation, ses propositions doivent figurer dans le PV. Leur absence pourrait laisser penser qu\u2019aucune n\u00e9gociation s\u00e9rieuse n\u2019a eu lieu.<\/em><\/p>\n\n\n\n<p>I<em>l est crucial de distinguer les propositions des mesures unilat\u00e9rales\u202f: les confondre reviendrait \u00e0 nier l\u2019existence m\u00eame de la n\u00e9gociation et fragiliserait toute discussion ult\u00e9rieure (car une proposition suppose un dialogue, l\u00e0 o\u00f9 des mesures unilat\u00e9rales ne supposent aucune concertation).<\/em><\/p>\n\n\n\n<p><em>Plusieurs de nos propositions sont rest\u00e9es sans r\u00e9ponse. Nous le d\u00e9plorons, car notre Organisation reste attach\u00e9e \u00e0 un dialogue social loyal et suffisamment s\u00e9rieux pour permettre de v\u00e9ritables \u00e9changes.<\/em><\/p>\n\n\n\n<p><em>Nous exigeons que le PV soit corrig\u00e9 afin de refl\u00e9ter toutes les propositions et r\u00e9ponses des parties pour la bonne information des salari\u00e9s, conform\u00e9ment aux articles L.2242-5 et L.2242-6 du Code du travail.<\/em><\/p>\n\n\n\n<p><em>L\u2019article L.2242-6 pr\u00e9cise que \u00ab\u00a0l&rsquo;engagement s\u00e9rieux et loyal des n\u00e9gociations implique que, dans les entreprises o\u00f9 sont constitu\u00e9es une ou plusieurs sections syndicales d&rsquo;organisations repr\u00e9sentatives, l&#8217;employeur ait convoqu\u00e9 \u00e0 la n\u00e9gociation les organisations syndicales repr\u00e9sentatives dans l&rsquo;entreprise et fix\u00e9 le lieu et le calendrier des r\u00e9unions. L&#8217;employeur doit \u00e9galement leur avoir communiqu\u00e9 les informations n\u00e9cessaires pour leur permettre de n\u00e9gocier en toute connaissance de cause et avoir r\u00e9pondu de mani\u00e8re motiv\u00e9e aux \u00e9ventuelles propositions des organisations syndicales.\u202f\u00a0\u00bb.<\/em><\/p>\n\n\n\n<p><em>Notre Organisation reste attach\u00e9e \u00e0 un dialogue social de qualit\u00e9, mais elle ne peut accepter que les r\u00e8gles l\u00e9gales et le principe de loyaut\u00e9 soient ignor\u00e9s.
