{"id":588,"date":"2016-09-30T07:15:53","date_gmt":"2016-09-30T06:15:53","guid":{"rendered":"http:\/\/foastek.fr\/?p=588"},"modified":"2016-10-07T08:21:28","modified_gmt":"2016-10-07T07:21:28","slug":"protection-des-parents-contre-le-licenciement","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=588","title":{"rendered":"Protection des parents-salari\u00e9s contre le licenciement"},"content":{"rendered":"<h3>P\u00e9riode de protection de la m\u00e8re<\/h3>\n<p>Apr\u00e8s un cong\u00e9 de maternit\u00e9, une salari\u00e9e b\u00e9n\u00e9ficie d\u2019une <strong>p\u00e9riode de protection dite \u00ab relative \u00bb<\/strong>, durant laquelle l\u2019employeur ne peut pas rompre son contrat de travail, sauf faute grave non li\u00e9e \u00e0 la grossesse ou impossibilit\u00e9 de maintenir le contrat de travail \u00e9trang\u00e8re \u00e0 la grossesse ou \u00e0 l\u2019accouchement. Cette p\u00e9riode est d\u00e9sormais fix\u00e9e \u00e0 <strong>10 semaines apr\u00e8s le cong\u00e9 de maternit\u00e9<\/strong> (art. L. 1225-4), au lieu de 4 semaines ant\u00e9rieurement.<\/p>\n<p>Le <strong>point de d\u00e9part de la p\u00e9riode de protection<\/strong> de 10 semaines est repouss\u00e9 si la salari\u00e9e prend des cong\u00e9s pay\u00e9s \u00ab imm\u00e9diatement \u00bb apr\u00e8s son cong\u00e9 maternit\u00e9. Dans ce cas, pendant ses cong\u00e9s pay\u00e9s, la salari\u00e9e b\u00e9n\u00e9ficie de la protection \u00ab absolue \u00bb pr\u00e9vue pendant le cong\u00e9 de maternit\u00e9 (art. L. 1225-4). A priori, ce m\u00e9canisme de \u00ab report \u00bb ne joue pas si la salari\u00e9e reprend, m\u00eame bri\u00e8vement, le travail avant de prendre ses cong\u00e9s pay\u00e9s.<\/p>\n<p>Les m\u00eames r\u00e8gles s\u2019appliquent au <strong>cong\u00e9 d\u2019adoption<\/strong> (art. L. 1225-38).<\/p>\n<h3>P\u00e9riode de protection du conjoint<\/h3>\n<p><strong>La p\u00e9riode de protection relative accord\u00e9e au \u00ab salari\u00e9 \u00bb<\/strong> (en d\u2019autres termes, le p\u00e8re de l\u2019enfant) pendant les semaines suivant la naissance de son enfant est \u00e9galement port\u00e9e de 4 \u00e0 <strong>10 semaines<\/strong>. Par exception, l\u2019employeur peut, comme auparavant, rompre le contrat s\u2019il justifie d\u2019une faute grave du salari\u00e9 ou de son impossibilit\u00e9 de maintenir ce contrat pour un motif \u00e9tranger \u00e0 l\u2019arriv\u00e9e de l\u2019enfant (art. L. 1225-4-1).<\/p>\n<h3>Sanction financi\u00e8re de l\u2019employeur<\/h3>\n<p>Enfin, la loi pr\u00e9cise le r\u00e9gime de la <strong>sanction indemnitaire<\/strong> en cas de prononc\u00e9 d\u2019un licenciement en violation des p\u00e9riodes de protection li\u00e9e \u00e0 la maternit\u00e9 (situation de grossesse, p\u00e9riode du cong\u00e9 de maternit\u00e9 et cong\u00e9s pay\u00e9s pris imm\u00e9diatement \u00e0 la suite, 10 semaines suivantes). En cas d\u2019impossibilit\u00e9 ou d\u2019absence de demande de la salari\u00e9e d\u2019\u00eatre r\u00e9int\u00e9gr\u00e9e, l\u2019employeur devra lui verser une indemnit\u00e9 correspondant au moins <strong>aux salaires des 6 derniers mois<\/strong>, quel que soit l\u2019effectif de l\u2019entreprise ou l\u2019anciennet\u00e9 du salari\u00e9 (art.
