Elle confirme ainsi sa vigilance sur les m\u00e9thodes d\u2019\u00e9valuation susceptibles d\u2019introduire une appr\u00e9ciation morale ou personnelle du salari\u00e9.<\/em><\/p>\n\n\n\n<p><strong>1. Le rappel du cadre juridique<\/strong><\/p>\n\n\n\n<p>En application des articles L.1121-1, L.1222-2 et L.1222-3 du Code du travail, l\u2019\u00e9valuation du salari\u00e9 n\u2019est licite que si elle repose sur des crit\u00e8res :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pr\u00e9cis,<\/li>\n\n\n\n<li>objectifs,<\/li>\n\n\n\n<li>pertinents au regard de la finalit\u00e9 poursuivie,<\/li>\n\n\n\n<li>et proportionn\u00e9s.<\/li>\n<\/ul>\n\n\n\n<p>L\u2019employeur peut int\u00e9grer des comp\u00e9tences comportementales dans son dispositif, mais uniquement lorsque celles-ci sont rattachables \u00e0 l\u2019ex\u00e9cution des missions du salari\u00e9 et sont formul\u00e9es de mani\u00e8re v\u00e9rifiable.<\/p>\n\n\n\n<p><strong>2. Les crit\u00e8res sanctionn\u00e9s par la Cour<\/strong><\/p>\n\n\n\n<p>Dans l\u2019affaire soumise \u00e0 la Cour, le dispositif d\u2019\u00e9valuation comportait des items tels que \u00ab optimisme \u00bb, \u00ab honn\u00eatet\u00e9 \u00bb ou \u00ab bon sens \u00bb. Ces notions ont \u00e9t\u00e9 jug\u00e9es :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>trop vagues et impr\u00e9cises,<\/li>\n\n\n\n<li>non mesurables dans le cadre professionnel,<\/li>\n\n\n\n<li>\u00e0 connotation morale, portant atteinte \u00e0 la sph\u00e8re personnelle du salari\u00e9.<\/li>\n<\/ul>\n\n\n\n<p>Elles ne permettent pas une appr\u00e9ciation objective du travail ni une transparence suffisante du processus d\u2019\u00e9valuation.<\/p>\n\n\n\n<p><strong>3. Cons\u00e9quence : l\u2019illic\u00e9it\u00e9 du dispositif<\/strong><\/p>\n\n\n\n<p>La Cour confirme l\u2019illic\u00e9it\u00e9 de l\u2019ensemble du dispositif d\u2019entretien, y compris dans ses composantes techniques, d\u00e8s lors que la partie comportementale ne pouvait \u00eatre consid\u00e9r\u00e9e comme accessoire.
