Celle-ci ne peut donc pas obtenir l&rsquo;indemnit\u00e9 forfaitaire pour travail dissimul\u00e9, seuls des dommages et int\u00e9r\u00eats peuvent lui \u00eatre accord\u00e9s.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ce n\u2019est pas la premi\u00e8re fois que la Cour de cassation en d\u00e9cide ainsi. En effet compte tenu de son obligation l\u00e9gale de s\u00e9curit\u00e9, l&#8217;employeur ne doit pas demander au salari\u00e9 de travailler durant un arr\u00eat maladie, ni m\u00eame le laisser agir en ce sens. La Cour de cassation a d\u2019ailleurs pr\u00e9c\u00e9demment pr\u00e9cis\u00e9 que le salari\u00e9 n&rsquo;avait pas \u00e0 apporter la preuve de son pr\u00e9judice pour obtenir des dommages-int\u00e9r\u00eats (cass. soc. 21 novembre 2012, n\u00b0 11-23009 D ; cass. soc. 4 septembre 2024, n\u00b0 23-15944 FSB ; cass. soc. 2 octobre 2024, n\u00b0 23-11582 FSB).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">D\u00e9cision : <em><a href=\"https:\/\/juricaf.org\/arret\/FRANCE-COURDECASSATION-20250924-2414134\">Cass. soc. 24 septembre 2025, n\u00b0 24-14134 FD<\/a><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>Il n&rsquo;y a pas de travail dissimul\u00e9 lorsque l&#8217;employeur oblige une salari\u00e9e \u00e0 travailler pendant un arr\u00eat maladie.
