{"id":6019,"date":"2025-12-09T16:20:27","date_gmt":"2025-12-09T15:20:27","guid":{"rendered":"https:\/\/foastek.fr\/?p=6019"},"modified":"2025-12-10T16:38:11","modified_gmt":"2025-12-10T15:38:11","slug":"alerte-du-cse-en-cas-datteinte-aux-droits-des-salaries","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=6019","title":{"rendered":"Alerte du CSE en cas d&rsquo;atteinte aux droits des salari\u00e9s"},"content":{"rendered":"\n<p><em>Lorsqu&rsquo;il constate une atteinte aux droits des salari\u00e9s (ex.\u00a0: harc\u00e8lement, discrimination), le CSE peut d\u00e9clencher une alerte aupr\u00e8s de l&#8217;employeur, obligeant ce dernier \u00e0 ouvrir une enqu\u00eate conjointe et \u00e0 faire cesser, le cas \u00e9ch\u00e9ant, cette situation. <\/em><\/p>\n\n\n\n<p><em>Dans un arr\u00eat publi\u00e9 du 3\u00a0d\u00e9cembre 2025, la Cour de cassation apporte plusieurs pr\u00e9cisions in\u00e9dites sur ce droit d\u2019alerte, notamment quant \u00e0 son p\u00e9rim\u00e8tre et \u00e0 sa mise en \u0153uvre en parall\u00e8le de la propre action en justice du salari\u00e9.<\/em><\/p>\n\n\n\n<p>La Cour de cassation consid\u00e8re que l\u2019action en justice individuelle du salari\u00e9 afin de faire valoir ses droits ne fait pas obstacle \u00e0 la mise en \u0153uvre du droit d\u2019alerte du CSE en vue de faire cesser l\u2019atteinte \u00e0 ces droits.<\/p>\n\n\n\n<p>La Cour de cassation estime qu\u2019en l\u2019absence de formalisme exig\u00e9 pour saisir l\u2019employeur,\u00a0le courrier d\u2019alerte de l\u2019\u00e9lu ne fixe pas les limites du litige.
