R.4624-31 du CdT<\/a>) <\/p>\n\n\n\n<p><strong>La visite m\u00e9dicale de reprise est obligatoire dans les cas suivants<\/strong> :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Accident d&rsquo;origine non professionnelle ou maladie d&rsquo;origine non professionnelle<\/strong> ayant entra\u00een\u00e9 <strong>un arr\u00eat de travail d&rsquo;au moins 60 jours<\/strong> ;<\/li>\n\n\n\n<li><strong>Accident du travail <\/strong>ayant entra\u00een\u00e9 un arr\u00eat <strong>d&rsquo;au moins 30 jours<\/strong> ;<\/li>\n\n\n\n<li><strong>Maladie professionnelle<\/strong> (quelle que soit la dur\u00e9e de l&rsquo;arr\u00eat) ;<\/li>\n\n\n\n<li><strong>Cong\u00e9 de maternit\u00e9<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>Cette visite<\/strong> a pour <strong>objectif <\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>de <strong>v\u00e9rifier l&rsquo;aptitude du salari\u00e9 \u00e0 reprendre son poste<\/strong> ;<\/li>\n\n\n\n<li><strong>d&rsquo;envisager des am\u00e9nagements<\/strong> ou <strong>un reclassement si n\u00e9cessaire<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>L\u2019organisation<\/strong> de la visite m\u00e9dicale de reprise <strong>incombe exclusivement \u00e0 l\u2019employeur<\/strong>. D\u00e8s la reprise du salari\u00e9, l\u2019employeur a\u00a0<strong>huit jours calendaires<\/strong>\u00a0pour organiser la visite de reprise.<\/p>\n\n\n\n<p id=\"block-c2ea5db4-ac24-48af-a049-122985b54604\">Afin que l&#8217;employeur puisse organiser la visite, <strong>le salari\u00e9 doit l&rsquo;informer de la date de fin de son arr\u00eat<\/strong>.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><span style=\"text-decoration: underline;\">Reprise du travail<\/span><\/p>\n\n\n\n<p>Par un arr\u00eat en date du 22 f\u00e9vrier 2017, la Cour de cassation a rappel\u00e9 qu\u2019<strong>un salari\u00e9 n\u2019a aucune obligation de reprendre son poste tant que la visite m\u00e9dicale de reprise n\u2019a pas eu lieu<\/strong>. <\/p>\n\n\n\n<p>Ce principe vise \u00e0 garantir la s\u00e9curit\u00e9 du salari\u00e9 et \u00e0 \u00e9viter qu\u2019il ne soit expos\u00e9 \u00e0 des conditions de travail inadapt\u00e9es \u00e0 son \u00e9tat de sant\u00e9.<\/p>\n\n\n\n<p>Si le salari\u00e9 choisit de ne pas se pr\u00e9senter sur son lieu de travail dans l\u2019attente de la visite m\u00e9dicale,\u00a0<strong>aucune sanction disciplinaire ne peut \u00eatre prononc\u00e9e \u00e0 son encontre<\/strong>. L\u2019absence est justifi\u00e9e par la situation m\u00e9dicale et le cadre l\u00e9gal applicable. Il n\u2019y a donc\u00a0<strong>ni abandon de poste<\/strong>, ni\u00a0<strong>manquement aux obligations contractuelles<\/strong>.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><span style=\"text-decoration: underline;\">R\u00e9mun\u00e9ration<\/span><\/p>\n\n\n\n<p>Par un arr\u00eat en date du 24 janvier 2024, la Cour de cassation a rappel\u00e9 que <strong>le salari\u00e9<\/strong>, qui <strong>ne reprend pas le travail \u00e0 l\u2019issue de son arr\u00eat maladie<\/strong> et <strong>fait savoir<\/strong> \u00e0 son employeur <strong>qu\u2019il se tient \u00e0 sa disposition pour passer la visite de reprise<\/strong>, <strong>a droit au paiement de sa r\u00e9mun\u00e9ration<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>Visite m\u00e9dicale de reprise (Art.
