L5213-6 du Code du travail) \u00e0 prendre \u00ab\u00a0les mesures appropri\u00e9es\u00a0\u00bb pour adapter le poste de travail \u00e0 l\u2019\u00e9tat de sant\u00e9 du salari\u00e9 RQTH. L\u2019am\u00e9nagement des horaires de travail (temps partiel th\u00e9rapeutique, horaires d\u00e9cal\u00e9s pour \u00e9viter les transports en heure de pointe, pauses\u2026) fait partie int\u00e9grante de ces mesures.<\/p>\n\n\n\n<p>L\u2019employeur ne peut pas se contenter d\u2019un refus de principe. Il doit prouver qu\u2019il a activement recherch\u00e9 une solution.<\/p>\n\n\n\n<p>L\u2019employeur ne peut refuser un am\u00e9nagement que s\u2019il prouve que celui-ci \u00ab\u00a0entra\u00eene des charges disproportionn\u00e9es\u00a0\u00bb (d\u00e9sorganisation profonde de l\u2019entreprise ou co\u00fbt financier excessif).<\/p>\n\n\n\n<p>Si le refus de l&#8217;employeur est abusif c&rsquo;est \u00e0 dire n\u2019est pas justifi\u00e9 par \u00ab une charge disproportionn\u00e9e\u00bb, il y a plusieurs recours possible :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Se faire accompagner par un repr\u00e9sentant du personnel (CSE, syndicat)<\/li>\n\n\n\n<li>Contacter la M\u00e9decine du Travail<\/li>\n\n\n\n<li>Contacter l&rsquo;Inspection du Travail<\/li>\n\n\n\n<li>Contacter le D\u00e9fenseur des droits<\/li>\n\n\n\n<li>Saisir le Conseil des Prud&rsquo;hommes<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>RQTH = Reconnu en Qualit\u00e9 de Travailleur Handicap\u00e9 L\u2019employeur est oblig\u00e9 (art.
