{"id":6342,"date":"2026-06-04T14:45:15","date_gmt":"2026-06-04T13:45:15","guid":{"rendered":"https:\/\/foastek.fr\/?p=6342"},"modified":"2026-06-11T14:56:52","modified_gmt":"2026-06-11T13:56:52","slug":"6342","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=6342","title":{"rendered":"Protection et Accompagnement des parents d&rsquo;enfants gravement malades"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">La loi visant \u00e0 am\u00e9liorer la protection et l\u2019accompagnement des parents d&rsquo;enfants atteints d\u2019un cancer, d\u2019une maladie grave ou d\u2019un handicap a \u00e9t\u00e9 d\u00e9finitivement adopt\u00e9e le 2 juin 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les principales mesures sont<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"text-decoration: underline;\">Cong\u00e9 en cas d&rsquo;annonce de la survenue d&rsquo;un handicap, d&rsquo;une pathologie chronique n\u00e9cessitant un apprentissage th\u00e9rapeutique ou d&rsquo;un cancer chez un enfant<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Le cong\u00e9 passe \u00e0 10 jours ouvrables (minimum).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les dur\u00e9es de ce cong\u00e9 sont des dur\u00e9es minimales, qui peuvent \u00eatre fix\u00e9es \u00e0 un niveau sup\u00e9rieur par convention ou accord collectif d&rsquo;entreprise ou, \u00e0 d\u00e9faut, convention ou accord de branche (c. trav. art. L. 3142-4).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"text-decoration: underline;\">Protection des parents pendant le cong\u00e9 de pr\u00e9sence parentale<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Jusqu&rsquo;\u00e0 pr\u00e9sent, <strong>aucun employeur ne peut rompre le contrat de travail d&rsquo;un salari\u00e9<\/strong> pendant un cong\u00e9 de pr\u00e9sence parentale, ni pendant les p\u00e9riodes travaill\u00e9es si le cong\u00e9 de pr\u00e9sence parentale est fractionn\u00e9 ou pris \u00e0 temps partiel, sauf s&rsquo;il justifie d&rsquo;une faute grave de l&rsquo;int\u00e9ress\u00e9 ou de son impossibilit\u00e9 de maintenir ce contrat pour un motif \u00e9tranger \u00e0 l&rsquo;\u00e9tat de sant\u00e9 de l&rsquo;enfant de l&rsquo;int\u00e9ress\u00e9 (c. trav. art. L. 1225-4-4).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La loi ajoute que <strong>cela ne sera pas non plus possible pendant les 10 semaines suivant l\u2019expiration de ce cong\u00e9<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"text-decoration: underline;\">D\u00e9lai de pr\u00e9venance de l\u2019employeur r\u00e9duit<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Jusqu\u2019\u00e0 pr\u00e9sent, <strong>le salari\u00e9<\/strong> qui souhaitait b\u00e9n\u00e9ficier du cong\u00e9 de pr\u00e9sence parentale <strong>devait en informer l&#8217;employeur au moins 15 jours avant le d\u00e9but du cong\u00e9<\/strong> (c. trav. art. L. 1225-63).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La loi <strong>r\u00e9duit \u00e0 10 jours <\/strong>ce d\u00e9lai de pr\u00e9venance (loi, art. 6, 1\u00b0 ; c. trav. art. L. 1225-63 modifi\u00e9).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"text-decoration: underline;\">Am\u00e9nagement d\u2019horaires pour les parents<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Jusqu\u2019\u00e0 ce jour, seuls les aidants familiaux et les proches d&rsquo;une personne handicap\u00e9e b\u00e9n\u00e9ficiaient d&rsquo;un am\u00e9nagement d&rsquo;horaires individualis\u00e9s propre \u00e0 faciliter l&rsquo;accompagnement de cette personne (c. trav. art. L. 3121-49).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans la loi, le droit \u00e0 un am\u00e9nagement des horaires de travail est \u00e9largi aux parents ou responsables l\u00e9gaux d\u2019un enfant dont l\u2019\u00e9tat de sant\u00e9 rend indispensable une pr\u00e9sence soutenue et des soins contraignants (loi art. 5, 2\u00b0 ; c. trav. art.
