{"id":6358,"date":"2026-05-29T16:04:26","date_gmt":"2026-05-29T15:04:26","guid":{"rendered":"https:\/\/foastek.fr\/?p=6358"},"modified":"2026-06-11T16:46:14","modified_gmt":"2026-06-11T15:46:14","slug":"harcelement-sexuel-dambiance-il-nest-pas-necessaire-que-les-propos-ou-comportements-visent-personnellement-la-salariee","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=6358","title":{"rendered":"Harc\u00e8lement sexuel d&rsquo;ambiance : il n&rsquo;est pas n\u00e9cessaire que les propos ou comportements visent personnellement la salari\u00e9e"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Dans un arr\u00eat du 28 mai 2026, la Cour de cassation sanctionne le harc\u00e8lement d&rsquo;ambiance dont une salari\u00e9e a \u00e9t\u00e9 victime, m\u00eame si elle n\u2019\u00e9tait pas vis\u00e9e directement par les actes en cause.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation rappelle tout d\u2019abord qu\u2019aucun salari\u00e9 ne doit pas subir des faits de harc\u00e8lement sexuel, constitu\u00e9 par des propos ou comportements \u00e0 connotation sexuelle r\u00e9p\u00e9t\u00e9s qui, soit portent atteinte \u00e0 sa dignit\u00e9 en raison de leur caract\u00e8re d\u00e9gradant ou humiliant, soit cr\u00e9ent \u00e0 son encontre une situation intimidante, hostile ou offensante (c. trav.&nbsp;<a target=\"_blank\" href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L1153-1&amp;idspad=LEGIARTI000043893894\" rel=\"noreferrer noopener\">art. L. 1153-1<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour la Cour, il en r\u00e9sulte que&nbsp;<strong>des propos \u00e0 connotation sexuelle ou sexiste adress\u00e9s \u00e0 plusieurs salari\u00e9s, ou de tels comportements adopt\u00e9s devant plusieurs salari\u00e9s, sont susceptibles d&rsquo;\u00eatre subis par chacun<\/strong>&nbsp;d&rsquo;entre eux.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par ailleurs, la Cour de cassation souligne qu\u2019un salari\u00e9 ne peut pas \u00eatre sanctionn\u00e9, licenci\u00e9 ou faire l&rsquo;objet d&rsquo;une mesure discriminatoire pour avoir t\u00e9moign\u00e9 ou relat\u00e9 des faits de harc\u00e8lement sexuel (c. trav.\u00a0<a href=\"https:\/\/rfsocial.grouperf.com\/lien_spad\/?base=LEGI&amp;orig=REVUE_RF_FH&amp;code=LEGITEXT000006072050&amp;numero=L1153-3&amp;idspad=LEGIARTI000026268390\" target=\"_blank\" rel=\"noreferrer noopener\">art. L. 1153-3<\/a>). Et qu\u2019une mesure prise pour ces raisons est nulle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour la Cour de cassation, au regard des propos et comportements \u00e0 connotation sexuelle ou sexiste adress\u00e9s ou adopt\u00e9s de mani\u00e8re r\u00e9p\u00e9t\u00e9e par le manager la salari\u00e9e et ses coll\u00e8gues, la salari\u00e9e s\u2019\u00e9tait trouv\u00e9e contrainte de subir un environnement de travail humiliant et d\u00e9gradant.
