{"id":6390,"date":"2026-06-12T11:55:21","date_gmt":"2026-06-12T10:55:21","guid":{"rendered":"https:\/\/foastek.fr\/?p=6390"},"modified":"2026-07-01T14:42:07","modified_gmt":"2026-07-01T13:42:07","slug":"grossesse-une-salariee-na-pas-a-informer-son-employeur-de-son-etat-de-grossesse","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=6390","title":{"rendered":"Grossesse : une salari\u00e9e n\u2019a pas \u00e0 informer son employeur de son \u00e9tat de grossesse."},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Dans un arr\u00eat du 3 juin 2026, la Cour de Cassation rappelle un principe essentiel : une salari\u00e9e n\u2019est pas tenue de r\u00e9v\u00e9ler sa grossesse \u00e0 son employeur, sauf lorsqu\u2019elle souhaite b\u00e9n\u00e9ficier des dispositions l\u00e9gales de protection qui y sont attach\u00e9es.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#x1f449; Les faits<br>Une salari\u00e9e travaillant dans le secteur de la chimie avait \u00e9t\u00e9 licenci\u00e9e pour faute grave apr\u00e8s avoir tard\u00e9 \u00e0 informer son employeur de sa grossesse.<br>L\u2019employeur lui reprochait notamment de l\u2019avoir emp\u00each\u00e9 de prendre les mesures n\u00e9cessaires pour prot\u00e9ger sa <a href=\"https:\/\/www.linkedin.com\/search\/results\/all\/?keywords=%23sant%C3%A9&amp;origin=HASH_TAG_FROM_FEED\"><strong>#sant\u00e9<\/strong><\/a> et celle de son enfant \u00e0 na\u00eetre.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#x2696;&#xfe0f; La d\u00e9cision de la Cour de cassation<br>La Haute juridiction casse la d\u00e9cision de la cour d\u2019appel.<br>Elle rappelle qu\u2019une salari\u00e9e enceinte n\u2019a aucune obligation d\u2019informer son employeur de son \u00e9tat de grossesse et que le fait de ne pas le faire ne peut justifier un licenciement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#x27a1;&#xfe0f; Plus largement, la Cour rappelle qu\u2019un licenciement prononc\u00e9 en raison, m\u00eame partiellement, de l\u2019\u00e9tat de grossesse d\u2019une salari\u00e9e est nul.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#x1f4cc; \u00c0 retenir : l\u2019employeur ne peut pas reprocher \u00e0 une salari\u00e9e de ne pas avoir r\u00e9v\u00e9l\u00e9 sa grossesse.
