{"id":6449,"date":"2026-07-09T14:09:57","date_gmt":"2026-07-09T13:09:57","guid":{"rendered":"https:\/\/foastek.fr\/?p=6449"},"modified":"2026-07-09T14:12:18","modified_gmt":"2026-07-09T13:12:18","slug":"rupture-conventionnelle-sous-la-menace-de-licenciement-la-cour-de-cassation-sanctionne","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=6449","title":{"rendered":"Rupture conventionnelle sous la menace de licenciement, la Cour de cassation sanctionne !"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">En juin 2026, la Cour de cassation a annul\u00e9 un licenciement prononc\u00e9 apr\u00e8s le refus d\u2019une salari\u00e9e de signer une rupture conventionnelle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le DRH l\u2019avait menac\u00e9e d\u2019engager une proc\u00e9dure de licenciement si elle refusait, des faits qualifi\u00e9s de harc\u00e8lement moral.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Une rupture conventionnelle doit toujours r\u00e9sulter d\u2019un accord libre et \u00e9clair\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La menace de licenciement utilis\u00e9e pour obtenir cette rupture peut \u00eatre qualifi\u00e9e de harc\u00e8lement moral (art. L. 1152-1 Code du travail).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un licenciement li\u00e9 \u00e0 ce harc\u00e8lement est nul (art.
