\/>ation juge que seules les heures suppl\u00e9mentaires effectu\u00e9es \u00e0 la demande de l\u2019employeur ou avec son accord, m\u00eame implicite, donnent lieu \u00e0 majoration (Cass. soc., 31-1-12,n\u00b010-21750).<\/p>\n<p>L\u2019attitude de l\u2019employeur qui a connaissance des nombreuses heures suppl\u00e9mentaires effectu\u00e9es par le salari\u00e9 et qui ne s\u2019y oppose pas \u00e9quivaut \u00e0 une autorisation d\u2019effectuer de telles heures (Cass. soc., 2-6-10, n\u00b008-40628).<\/p>\n<p>A l\u2019occasion d\u2019un arr\u00eat rendu le 21\u00a0septembre 2016, la Cour de cassation donne une nouvelle illustration de ce qui constitue ou non l\u2019accord de l\u2019employeur \u00e0 l\u2019accomplissement d\u2019heures suppl\u00e9mentaires.<\/p>\n<p>D\u00e8s lors que l\u2019employeur n\u2019a pas consenti \u00e0 la r\u00e9alisation des heures de travail suppl\u00e9mentaires dont il n\u2019avait pas eu connaissance, le salari\u00e9 ne peut pr\u00e9tendre au paiement de ces heures.<\/p>\n<p>En l\u2019esp\u00e8ce, le salari\u00e9 ne s\u2019\u00e9tait pas conform\u00e9 aux dispositions de l\u2019accord d\u2019entreprise sur les principes et modalit\u00e9s de recours aux heures suppl\u00e9mentaires lui imposant d\u2019obtenir l\u2019accord de son sup\u00e9rieur hi\u00e9rarchique pr\u00e9alablement \u00e0 l\u2019accomplissement d\u2019heures suppl\u00e9mentaires (Cass. soc., 21-9-16, n\u00b015-11231).<\/p>\n<p>Attention, il n\u2019existe pas de droit acquis \u00e0 l\u2019ex\u00e9cution d\u2019heures suppl\u00e9mentaires, sauf engagement de l\u2019employeur vis \u00e0 vis du salari\u00e9 \u00e0 lui en garantir l\u2019ex\u00e9cution d\u2019un certain nombre d\u2019heures.<\/p>\n<p>A d\u00e9faut d\u2019un tel engagement, seul un abus de l\u2019employeur dans l\u2019exercice de son pouvoir de direction peut ouvrir droit \u00e0 indemnisation (Cass. soc., 10-10-12, n\u00b011-10455).<\/p>\n<p>Ainsi, la suppression d\u2019heures suppl\u00e9mentaires par l\u2019employeur qui ne serait pas justifi\u00e9e au regard des int\u00e9r\u00eats de l\u2019entreprise peut caract\u00e9riser un manquement de l\u2019employeur \u00e0 son obligation de bonne foi dans l\u2019ex\u00e9cution du contrat de travail et ouvrir droit \u00e0 indemnisation (Cass. soc., 19-6-08,
