La justice a un mois pour rendre son avis.<\/p>\n<p>Si la justice reconnait le tort de l&#8217;employeur, le salari\u00e9 est alors consid\u00e9r\u00e9 comme licenci\u00e9 (et touchera les indemnit\u00e9s de licenciement correspondantes ainsi que les cong\u00e9s pay\u00e9s et son pr\u00e9avis).<\/p>\n<p>Si la justice ne reconnait pas le tort de l&#8217;employeur, le salari\u00e9 est alors consid\u00e9r\u00e9 comme d\u00e9missionnaire (pas d&rsquo;indemnit\u00e9s, pas droit au ch\u00f4mage).<\/p>\n<p>En 2015, la Cour de Cassation a estim\u00e9 qu&rsquo;une semaine sans travail \u00e9tait suffisamment grave pour condamner un employeur (Cour de cassation, chambre sociale, 9 juin 2015, n\u00b0 13-26.834).<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>A partir du moment o\u00f9 il y a un contrat de travail entre un salari\u00e9 et son employeur, l&#8217;employeur doit lui fournir du travail.
