{"id":88,"date":"2014-10-10T07:00:31","date_gmt":"2014-10-10T06:00:31","guid":{"rendered":"http:\/\/foastek.fr\/?p=88"},"modified":"2015-11-24T00:44:10","modified_gmt":"2015-11-23T23:44:10","slug":"lemployeur-doit-remettre-lattestation-pole-emploi-a-un-salarie-a-la-fin-du-contrat","status":"publish","type":"post","link":"https:\/\/foastek.fr\/?p=88","title":{"rendered":"L\u2019employeur doit remettre l\u2019attestation P\u00f4le Emploi \u00e0 un salari\u00e9 \u00e0 la fin du contrat !"},"content":{"rendered":"<p><a href=\"http:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000029486309&amp;fastReqId=222822067&amp;fastPos=1\" target=\"_blank\">L\u2019arr\u00eat N\u00b013-18850 de la Cour de Cassation du 17 septembre 2014<\/a> a indiqu\u00e9 qu\u2019un employeur doit obligatoirement remettre au salari\u00e9 en fin de contrat une attestation d\u2019assurance ch\u00f4mage pour P\u00f4le Emploi.<\/p>\n<p><strong>La remise tardive par l\u2019employeur de l\u2019attestation de P\u00f4le emploi \u00e0 un salari\u00e9, soit 8 jours apr\u00e8s la fin du pr\u00e9avis, entra\u00eene n\u00e9cessairement un pr\u00e9judice au salari\u00e9 qui doit \u00eatre r\u00e9par\u00e9 par les juges du fond.<\/strong><!--more--><\/p>\n<h4>Les documents obligatoire \u00e0 remettre<\/h4>\n<p>A la fin du contrat de travail d\u2019un salari\u00e9 en CDD ou CDI, l\u2019employeur doit obligatoirement remettre au salari\u00e9 :<\/p>\n<ul>\n<li><strong>un certificat de travail<\/strong>\u00a0: <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCode.do?idArticle=LEGIARTI000006901138&amp;idSectionTA=LEGISCTA000006195628&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120614\" target=\"_blank\">article L1234-19 du Code du Travail,<\/a> et <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCode.do?idArticle=LEGIARTI000021710601&amp;idSectionTA=LEGISCTA000018537558&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120614\" target=\"_blank\">D1234-6<\/a> contenant la date de son entr\u00e9e dans l\u2019entreprise, la date de sortie du salari\u00e9, la nature du ou des emplois occup\u00e9s par le salari\u00e9 et les p\u00e9riodes d\u2019occupation de ces emplois.<\/li>\n<li><strong>une attestation destin\u00e9e \u00e0 P\u00f4le Emploi<\/strong>\u00a0: <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCode.do;jsessionid=3934C89844CDA78B3E77E0B1745DCE8A.tpdjo10v_2?idSectionTA=LEGISCTA000018537548&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120830\" target=\"_blank\">articles R1234-9 \u00e0 12 du code du Travail<\/a> qui permet au salari\u00e9 de prouver la dur\u00e9e pendant laquelle le salari\u00e9 a travaill\u00e9 dans l\u2019entreprise et le niveau de ses r\u00e9mun\u00e9rations. Le motif de la rupture y est \u00e9galement indiqu\u00e9.<\/li>\n<li><strong>un re\u00e7u pour solde de tout compte<\/strong>\u00a0: <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCode.do;jsessionid=3934C89844CDA78B3E77E0B1745DCE8A.tpdjo10v_2?idSectionTA=LEGISCTA000018537554&amp;cidTexte=LEGITEXT000006072050&amp;dateTexte=20120830\" target=\"_blank\">articles D1234-7 et 8<\/a> sur lequel figure les sommes vers\u00e9es au salari\u00e9 au moment de son d\u00e9part. Le re\u00e7u pour solde de tout compte est envoy\u00e9 par lettre recommand\u00e9e.<\/li>\n<li><strong>une attestation d\u2019emploi<\/strong> sur demande du salari\u00e9.<\/li>\n<li><strong>un \u00e9tat r\u00e9capitulatif d\u2019\u00e9pargne salariale<\/strong>.<\/li>\n<\/ul>\n<p><strong>Attention :<\/strong> \u00e0 partir du 1er juin 2014, le certificat de travail doit mentionner le maintien, \u00e0 titre gratuit et pendant 1 an, des contrats compl\u00e9mentaires sant\u00e9 pour les salari\u00e9s involontairement priv\u00e9s d&#8217;emploi (hors faute lourde).
