Seule la seconde engage l\u2019employeur et vaut contrat.<\/p>\n<p>Ainsi, il est consid\u00e9r\u00e9 que l\u2019acte par lequel un employeur propose un engagement pr\u00e9cisant l\u2019emploi, la r\u00e9mun\u00e9ration et la date d\u2019entr\u00e9e en fonction et exprime la volont\u00e9 de son auteur d\u2019\u00eatre li\u00e9 en cas d\u2019acceptation, constitue une offre de contrat de travail, qui peut \u00eatre librement r\u00e9tract\u00e9e tant qu\u2019elle n\u2019est pas parvenue \u00e0 son destinataire. La r\u00e9tractation de l\u2019offre avant l\u2019expiration du d\u00e9lai fix\u00e9 par son auteur ou, \u00e0 d\u00e9faut, l\u2019issue d\u2019un d\u00e9lai raisonnable, fait obstacle \u00e0 la conclusion du contrat de travail et engage la responsabilit\u00e9 extra contractuelle de son auteur.<\/p>\n<p>En revanche, la promesse unilat\u00e9rale de contrat de travail est le contrat par lequel une partie, le promettant, accorde \u00e0 l&rsquo;autre, le b\u00e9n\u00e9ficiaire, le droit d&rsquo;opter pour la conclusion d&rsquo;un contrat de travail, dont l\u2019emploi, la r\u00e9mun\u00e9ration et la date d\u2019entr\u00e9e en fonction sont d\u00e9termin\u00e9s, et pour la formation duquel ne manque que le consentement du b\u00e9n\u00e9ficiaire.
